PC Res 2341RESOLUTION N0. 2341 PLANNING COMMISSION After notification and public hearing as specified by law on proposed amendments to the text of Section 21.02.090 of the Campbell Municipal Code; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed (TA 85-03). After due consideration of all evidence presented and based upon the following findings, the Commission did determine that there was a significant need to amend Section 21.01.090 of the Campbell Municipal Code: 1. The proposed amendment will amend Section 21.02.090 regarding the definition of "building height". 2. The proposed amendment will add Section 21.02.093 regarding the definition of "building wall height". 3. The proposed amendment will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons _ residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welf are of the City. The Planning Commission does hereby recommend that the City Council adopt the attached Ordinance enacting the necessary legislation to make the proposed text amendment effective. Ree Secretary ORDINANCE N0. BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AMENDING SECTION 21:02.090 AND ADDING SECTION 21.02.093 TO THE CAMPBELL MUNICIPAL CODE (TA 85-03). The City Council of the City of Campbell does ordain as follows: SECTION ONE: That Chapter/Section 21.02.090 of the Campbell Municipal Code be amended as set forth in Exhibit A, attached hereto. SECTION TWO: That Section 21.02.093 regarding definition of "building wall height" be added to the Campbell Municipal Code as set forth in Exhibit A, attached hereto. SECTION THREE: This Ordinance shall become effective 30 days _ following its passage and adoption and shall be published once within 15 days upon passage and adoption in the San Jose Mercury News, a newspaper of general circulation in the City of Campbell, County of Santa Clara. Coyne City Clerk EXHIBIT A PROPOSED DEFINITIONS 21.01.090 Building Height. "Building height" means the vertical distance measured from the average elevation of the finished grade within 20 feet of the structure to the highest point of the building. 21.02.093 Building Wall Height. "Building wall height" (to be used for the purpose of determining setback requirements) means the vertical distance measured from the average ele- _ vation of the finished grade within 20 feet of the structure to the highest point of the roof surface, if a flat roof; top of the deck line of a mansard roof; and to the mean height level between the eaves and ridge for a gable, hip or gambrel roof.
