PC Res 2329RESOLUTION NO. 2329 PLANNING COMMISSION After notification and public hearing as specified by law on the application of Mr. Alan Maes for a use permit to allow the establishment of a lounge with on-sale beer and wine and a disco on property known as 2097 S. Bascom Avenue in a C-2-S (General Commercial) Zoning District, as per application filed in the Office of the Planning Director on March 28, 1985, and after presentation by the Planning Director, proponents and opponents, the hearing was closed (UP 85-04). After due consideration of all evidence presented, the Commission did find as follows: 1. That the applicant wishes to withdraw his application in that the referenced property has already been leased. 2. That the applicant is requesting a refund of his $350 applica- tion fee. 3. That a portion of this application fee has been expended in noticing for public hearing as required by law. Based on the above findings, the Planning Commission does hereby deny without prejudice the requested use permit, and further does recommend to the City Council that. the applicant be given a partial refund in the amount of $175.00.
