PC Res 2322RESOLUTION NO. 2322 PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA After notification and public hearing as specified by law on proposed amendments to the text of Chapter 21.08 of the Campbell Municipal Code, and after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented and based upon the following findings, the Commission did determine that there was not a significant need to amend Chapter 21.08 of the Campbell Municipal Code, as it applies to residential building height: 1. That the policy regarding residential building height remain as existing, which is: "Campbell allows a single family residential structure to be constructed at a maximum of 2-1/2 stories and 35' in height."; and that all undeveloped lots zoned R-1-8, R-1-9, R-1-10, and R-1-16 be subject to Site and Architectural review. 2. That the recommendation will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the city. _._ The Planning Commission does hereby recommend that the City Council adopt the ordinance attached hereto as Exhibit "A" enacting the necessary legislation to make the proposed text amendment effective. BEING AN ORDINANCE OF THE CITY OF CAMPBELL AMENDING CHAPTER 21.08 OF THE CAMPBELL MUNICIPAL CODE (TA 85-01) The City Council of the City of Campbell does ordain as follows: SECTION ONE: That Chapter 21.08 of the Campbell Municipal Code remain as it exists, with regard to residential building height, as set forth in Exhibit A attached hereto. SECTION TWO: This ordinance shall become effective 30 days following its passage and adoption and shall be published once within 15 days upon passage and adoption in the San Jose Mercury News, a newspaper of general circulation in the City of Campbell, County of Santa Clara.
