PLANNING COMMISSION
After notification and public hearing as specified by law on the application
of Mr. Vadim Yampolski fora use permit to allow on-sale beer and wine in an
existing delicatessen on property known as 1783 S. Winchester Blvd. in a
C-2-S (General Commercial) Zoning District, as per application filed in the
Office of the Planning Director on September 4, 1984, and after presentation
by the Planning Director, proponents and opponents, the hearing was closed
(UP 84-13).
After due consideration of all evidence presented, the Commission did find
as follows:
1. That the applicant wishes to withdraw his application in
that he has sold the business.
2. That the applicant is requesting a refund of his $350
application fee.
3. That a portion of this application fee has been expended in
noticing for public hearing and to surrounding property owners
as required by law.
Based on the above finding, the Planning Commission does hereby deny without
prejudice the requested use permit, and further does recommend to the City
Council that the applicant be given a partial refund in the amount of $250.
PASSED AND ADOPTED this 25th day of September 1984 by the following roll
call vote:
AYES: Commissioners: Kasolas, Perrine, Christ, Howard, Fairbanks,

To whom it may concerns:
Due to the fact that I am in the process of selling my Delicatessen and
the recently applied for Liquor Licens would only complicate the matter,
I must request from you a reverse action and that my License Fee to be
returned to me.
Both of us, the puchaeier of my business and myself concluded that to
si~,l.ify the matter it's the best solution. At a latter time the buyer
has the intention to reapply for it, my understanding is.
Therefor~~if you kindly, please, abort this Transaction at this time
and return my submitted License Fee to me as soon as possible.
