BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A
CONDITIONAL USE PERMIT TO ALLOW A CELLULAR
ANTENNA FACILITY AND GROUND-LEVEL EQUIPMENT
ON PROPERTY LOCATED AT 1630 W. CAMPBELL
AVENUE IN A C-1-S (NEIGHBORHOOD COMMERCIAL)
ZONING DISTRICT. APPLICATION OF MS. PATTY
MEJIA, ON BEHALF OF SPRINT SPECTRUM. UP 96-17.
After notification and public heating, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application UP 96-17:
Transceiving or transmitting facilities are permitted in the C-1-S Zoning District
subject to the approval of a conditional use permit.
The project is compatible with the existing building and site, subject to the
conditions of approval.

The proposed monopole, is located on the side of an existing building and is visible
from public view.
A conditional of approval requiring landscaping consisting of ground cover,
shrubs, and a low growing tree around the base of the monopole will provide
screening of a portion of the monopole from public view.
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:
The proposed project is consistent with the General Plan and the local zoning
ordinance, and
The proposed project as conditioned will aid in the harmonious development of the
immediate area;
The proposed site is of adequate shape and size to accommodate the yards, walls,
fences, screening, landscaping and other development features required in order to
integrate said use with uses in the surrounding area.

The establishment, maintenance or operation of the use applied for will not be
detrimental to the health, safety, peace, morals, comfort, or general welfare of
persons residing or working in the neighborhood of such proposed use, or be
detrimental or injurious to property and improvements in the neighborhood or to the
general welfare of the City.
Further, the applicants are notified as part of this application that they are required to
comply with all applicable Codes and Ordinances of the City of Campbell and the State
of California which pertain to this application and are not herein specified. And, that this
approval is granted subject to the following Conditions of Approval.
Approved Project: Approval is granted for a Use Permit allowing for the installation
of a cellular transceiving facility on property located at 1630 W. Campbell Avenue.
Project approval shall substantially comply with project plans prepared by Alvar
Inc., dated 11/25/96 except as modified herein in the Conditions of Approval.
Project Design: The facility shall consist of one (1) monopole with an attached light
fixture and located in the parking lot as indicated on approved site plan, and ground
level equipment located within the existing trash enclosure that shall be modified to
accommodate the equipment.

Permits: Applicant shall obtain any permits deemed necessary by the Building
Official or the Uniform Building Code.
Development Approval Expiration: The Use Permit approval (UP 96-17) for this
project is valid for one year from the date of the Planning Commission's approval.
All conditions of approval specified herein must be completed within one year from
the date of approval or the Use permit shall be void.
Landscaping: Applicant shall submit two (2) sets of landscaping plans indicating a
landscape planter at the base of the monopole. The landscape planter shall
comprise the area currently delineated as a painted curb, and consist of ground
cover, shrubs, and a low growing tree. Landscaping plans shall provide planting
details and irrigation and submitted to the Community Development Department
for review and approval prior to the issuance of building permits.

Review of Approval: This approval is effective for five years. The owner or
owner's representative will revisit the Use Permit application every five years to
determine that the equipment is consistent with current technology of new
installations at that time and is visually less obtrusive as compared with what is in
place at this time.
