RESOLUTION N0. 2237
After notification and public hearing as specified by law on the application
of Dr. Gordon Smith for a variance to reduce the garage setback from 25 to
20 feet, and a variance to reduce the length of the garage from 20 feet to
19 feet on property known as 399 N. Milton Avenue in an R-1 (Single Family/
Low Density Residential) Zoning District, as per the application filed in
the Office of the Planning Department on October 13, 1983, and after pre-
sentation by the Planning Director, proponents and opponents, the hearing
was closed (V 83-04).
After due consideration of all evidence presented, the Commission did find
as follows:
1. A hardship exists due to the uniqueness of the property and
the buildings on the site; and
2. Approval of this variance will not be harmful to the estab-
lishment, maintenance, and operation of the proposed use,
and will not be detrimental to the health, safety, peace, morals,
comfort, or general welfare of ihersons residing or working in
the neighborhood, or be detrimental or injurious to the property
or improvements in the neighborhood or the general welfare of the
City.
Based upon these findings, the Planning Commission does hereby approve this
requested variance.
