RESOLUTION N0. 2203
After notification and public hearing as specified by law on proposed amend-
ments to the Campbell Nhmicipal Code adding Chapter 21.19 (Additional Living
Units), allowing additional living units in Single Family and other resident-
ial districts under certain conditions, and after presentation by the Planning
Director, proponents and opponents, the hearing was closed (TA 83-02).
After due consideration of all evidence presented and based upon the following
findings, the Commission did determine that there was a significant need to
amend the Campbell Municipal Code:
1. That the proposed addition of Chapter 21.19 (Additional Living
Units) will allow additional living units in Single Family and.
other residential districts under certain conditions.
2. That the proposed addition of Chapter 21.19 will provide for
conformance with SB 1150 and SB 1534, known as "Granny Flats"
and "Companion Units" legislation.
3. That the proposed addition of Chapter 21.19 will regulate second
units, and retain control and flexibility over where and under
what conditions the units would be permitted.
4. That the proposed addition of Chapter 21.19 sets specific develop- -
ment standards and restrictions for second units.
5. That the proposed addition of Chapter 21.19 provides that a use
permit must be approved, with the Planning Commission considering
the impact on the neighbors and the neighborhood, for the addition
of a second unit.
6. That the proposed amendment will not be detrimental to the health,
safety, peace, morals, comfort, or general welfare of persons re-
siding or working in the neighborhood of such proposed use, or be
detrimental or injurious to property and improvements in the nei-
ghborhoo d or to the general welfare of the City.
The Plarming Commissiondoes hereby recommend that the City Council adopt the
Ordinance attached hereto as Exhibit A enacting the necessary legislation to
make the proposed text amendment effective.
