PC Res 3075RESOLUTION NO. 3075 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A MODIFICATION TO A PLANNED DEVELOPMENT PERMIT TO ALLOW A 200 SQUARE FOOT ADDITION TO A PREVIOUSLY-APPROVED RETAIL BUILDING ON PROPERTY LOCATED AT 790 E. CAMPBELL AVENUE IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MR. CHARLES STEGNER. FILE NO. M 97- 02. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application M 97-02. No substantial evidence has been presented which shows that the project, as currently presented, and subject to the attached conditions, would have a significant effect upon the environment. The proposed project would result in a parking deficiency of 2(two) parking spaces, however, the proposed parking is considered adequate for the a retail building of this size. The revised building design provides an acceptable elevation adjacent to the parking area. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed development and uses clearly will result in a more desirable environment and use of the land than would be possible under any other zoning classification. The development and proposed land use is compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. The proposed development will not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole due to a lack of parking facilities. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is Planning Commission Resolution No. 3075 M 97-02 - 790 E. Campbell Avenue - Charles Stegner Page 2 required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. PLANNING DEPARTMENT 1. Approved Project: Approval is granted to construct an addition to a previously approved retail building on the project site. The building design shall substantially conform to the exhibits listed below, except as may be modified by the Conditions of Approval. A. Site and building plans prepared by Richard Fish, dated and revised January 30, 1997 Bo Approved building uses shall be restricted to commercial uses permitted in the C- 1-S(Neighborhood Commercial) Zoning District. Chapter 21.22, Campbell Municipal Code. Revised Site Plan and Elevations: Revised plans addressing the following modifications shall be submitted to the Planning Department for approval of the Community Development Director prior to the issuance of building permits. A. Provision of greater window insets along the south elevation or B. Provision of small planters along the south elevation adjacent to window openings. o All previous conditions of approval provided under City Council Resolution No. 9180 still apply to the Planned Development Permit (PD96-04).
