PC Res 3077RESOLUTION NO. 3077 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUS SITE APPROVAL TO ALLOW FACADE MODIFICATIONS FOR A NEW RESTAURANT USE (WRAPWORKS) ON PROPERTY LOCATED AT 1875 S. BASCOM AVENUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF CHEVY'S/ WRAPWORKS. FILE NO. M 97-03. After notification and public heating, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the heating was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application M 97-03. 1. The proposed project is consistent with the General Plan and Zoning designations which indicate a commercial land use for this property. The proposed project entails only exterior modifications which will not add additional square footage for the restaurant use and will, therefore, not require the provision of additional parking spaces for the shopping center. 3. The proposed building modifications are compatible with uses on site, the immediate area and the overall design of the Pmneyard Shopping Center. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project will aid in the enhancement and the harmonious development of the Pmneyard Shopping Center and the immediate area. The establishment, maintenance, or operation of the proposed project will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood. 2. The proposed site is adequate in size and shape to accommodate the proposed modification. 3. The proposed building modifications will not be inconsistent with the buildings on site. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Planning Commission Resolution No. 3077 M 97-03 - 1875 S. Bascom Avenue- Chevy's/WrapWorks Pase 2 Approved Plans: The applicant and all plans shall substantially comply with the Planning Commission approval. Said approval shall comply with plans submitted on February 20, 1997, with the exception of the tower element plans, which shall be revised to incorporate approvals by the Planning Commission. Revised plans for the tower element shall be submitted and reviewed by the Community Development Department prior to issuance of building permits. 2. Building Division Requirements: Applicant shall comply with all Building Code requirements and obtain necessary permits as determined by the Building Division. 3. Central Fire District Requirements: Applicant shall obtain any necessary permits and/or approvals as determined by the Central Fire District. Lighting: The proposed lighting for the tower element shall not interfere with adjacent properties. Should the City receive complaints from adjacent property owners regarding the lighting of the tower, the applicant shall respond with mitigation measures to be reviewed and approved by the Community Development Department.
