PC Res 3081RESOLUTION NO. 3081 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUS SITE APPROVAL (S 95-08) TO ALLOW BUILDING FACADE MODIFICATIONS FOR A NEW RESTAURANT (JOHNNY ROCKETS) ON PROPERTY LOCATED AT 1875 S. BASCOM AVENUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. FRANK TOLOUI. FILE NO. M 97-05. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application M 97-05 (S 95-08): The proposed project is consistent with the General Plan and Zoning designations which indicate a commercial land use for this property. ° The proposed project color, with a color change, is consistent with the architectural style and character of the Pruneyard Shopping Center. The proposed building modifications are compatible with the existing architectural features on the site and the overall design of the Pruneyard Shopping Center. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project will aid in the enhancement and the harmonious development of the Pruneyard Shopping Center and the immediate area. The proposed elevations will not result in a significant change and departure from the approved elevations of the shopping center. 3. The proposed modifications will be consistent with the buildings on site. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Approved Plans: The applicant and all plans shall substantially comply with the Planning Commission approval. Said approval shall comply with plans, prepared by Arch 10,consisting of three sheets, except as modified by the conditions of approval. Bascom Avenue - Johnny Rockets Page 2 Building Division Requirements: Applicant shall comply with all Building Code requirements and obtain necessary permits as determined by the Building Division. o Central Fire District Requirements: Applicant shall obtain any necessary permits and/or approvals as determined by the Central Fire District. ° Lighting: The details of proposed lighting for the exterior of the building to be approved by the Community Development Director prior to issuance of building permits. o Outdoor Seating Plan : Applicant to provide an outdoor seating plan for the approval of the Community Development Director depicting details of furniture and arrangement of outdoor seating. A minimum clear walkway width of 6' to be maintained through the courtyard area. ° Outdoor Music and Public Address System: Outdoor audio sound system shall not unreasonably interfere with the use of adjacent tenants in the shopping center and shall not be audible beyond property lines. No live entertainment is permitted. 7. Hours of Operation: Operational hours to be limited to 6 a.m. to 11 p.m. o Revised Elevations: Applicant to submit revised elevations to the Building Department reflecting a color sample to match the body wall colors utilized in the shopping center for the exterior facade.
