PC Res 3093RESOLUTION NO. 3093 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL GRANTING A SITE AND ARCHITECT~ APPROVAL TO ALLOW THE CONSTRUCTION OF FOUR SINGLE-FAMILY HOMES ON PROPERTIES LOCATED AT 1365 HARRIET AVENUE (S 97-06), 1375 HARRIET AVENUE (S 97-07), 1397 ROBNICK COURT (S 97-08) AND 1395 ROBNICK COURT (S 97-09) IN AN R-l-9 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MR. BRUCE BOWEN. FILE NOS. S 97-06 THROUGH S 97- 09. After notification and public heating, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the heating was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application S 97-06 through S 97-09. The proposed dwellings are well designed and architecturally compatible with the surrounding area by featuring traditional elements such as a porches and double hung windows. The proposed projects meets the development standards of the R-l-9 Zoning District and the San Tomas Area Neighborhood Plan. o The development of the property will result in a density of 2.2 units per gross acre which is consistent with the General Plan density of less than 3.5 units per gross acre shown for this area. The retention of the majority of the existing trees contributes to the quality of the development and enhances the neighborhood. o A condition of approval requiring additional architectural design details to the entry ways to the building for Lots 2 and Lots 4 will further enhance the proposed designs. o An initial study was prepared for this project in accordance with CEQA which determined that the project will not result in significant impacts to the environment. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project is consistent with the General Plan and zoning, and Planning Commission Resolution No. 3093 S 97-06 through S 97-09 - 1365 & 1375 Harriet Ave/1397 & 1395 Robnick Court Page 2 The proposed project will aid in the harmonious development of the immediate area. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions is in accordance with the ordinance of the City of Campbell and the State of Califomia. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: Approved Project: Approval is granted for a Site and Architectural Review Permit allowing four new single family residence on property located at 1365 Harriet Avenue (S 97-06); 1375 Harriet Avenue (S 97-07); 1397 Robniek Court (S 97- 08); and 1395 Robniek Court (S 97-09) Project approval shall substantially comply with project plans prepared by Chris Spaulding dated 4/4/97, except as modified by the Conditions of Approval herein. Ao Revised Front Entry_ Ways: Applicant shall provide revised elevations or details showing additional design treatment to enhance the front entry way design to Lot 2 for review and approval by the Site and Architectural Review Committee. Landscaping: Submit a landscaping plan indicating one tree for every 2,000 square feet of net lot area in accordance with the STANP to the Community Development Department prior to issuance of building permits. o Parcel Map: The applicant shall file and record a final parcel map and comply with the Conditions of Approval for PM 97-02 creating a four (4) lot subdivision prior to the issuance of building permits. Tree Protection: A tree protection plan prepared by a licensed arborist shall be submitted to the Planning Division providing tree protection measures during all phases of demolition, grading and construction. 5. Building Permits: Obtain all necessary building permits as determined by the Building Official prior to construction. 6. Park Impact Fee: Applicant shall pay a Park Impact Fee of $10,990 per dwelling unit prior to the issuance of a certificate of occupancy.
