PC Res 3096RESOLUTION NO. 3096 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL GRANTING A SITE AND ARCHITECTURAL APPROVAL TO ALLOW THE CONSTRUCTION OF A NEW SINGLE-FAMILY HOME ON PROPERTY LOCATED AT 1282 BURROWS ROAD IN AN R-l- 10 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF DAMIR & CATHY VUKOSA AND MLADEN & JELA BUBIC. FILE NO. S 97-12. After notification and public heating, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application S 97-12. The proposed dwelling is well designed and architecturally compatible with the surrounding area through orientation, and architectural enhancements such as one-story elements on the building sides. 2. The proposed project meets the development standards of the R-1-10 Zoning District and the San Tomas Area Neighborhood Plan. The development of the property will result in a density of 3.0 units per gross acre which is consistent with the General Plan density of less than 4.5 units per gross acre shown for this area. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project is consistent with the General Plan and Zoning, and 2. The proposed project will aid in the harmonious development of the immediate area. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions is in accordance with the ordinance of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: Planning Commission Resolution No. 3096 S 97-12 - 1282 Burrows Road Page 2 o o o Approved Project: Approval is granted for a Site and Architectural Review Permit allowing a new single family residence on property located at 1282 Burrows Road. Project approval shall substantially comply with project plans prepared by Frank Oldham, dated modified 6/16/97, except as modified by the Conditions of Approval herein. Landscaping: Prior to issuance of building permits, submit a landscaping plan to the Community Development Department indicating all trees on the site with a diameter of 4 inches or larger and any additional trees required to provide a minimum of 6 trees in accordance with the STANP, and the City's Water Efficient Landscaping Standards. (Planning Division) Property Maintenance Standard: The property shall be maintained free and clear of any combustible trash, debris and weeds. (Planning Division) Park Impact Fee: A Park Impact Fee of $10,900.00 shall be paid prior to an occupancy permit being issued for the new building.(Planning Division) Tree Protection: Prior to issuance of any grading or building permit, submit a plan indicating all trees on the site and protective fencing to be installed. This fencing shall remain on the site until landscape work is to commence or an occupancy permit is granted, whichever occurs first. The location of the fencing shall be no closer to the trunks than the dripline of the trees, and shall be a minimum of 4 feet in height. No storage or dumping of waste is to be permitted inside the fenced area. (Planning Division) Right-of-Way: Prior to issuance of any building permits for the site, the applicant shall grant additional right-of-way along the Burrows Road frontage to provide for 20' of right-of-way plus a 10' PSE beyond property line from the monumented centerline, as needed for public street and related purposes.(Public Works) o o Public Service Easement: Prior to issuance of any building permits for the site, the applicant shall grant an on-site 10' public service easement (P.S.E.) contiguous to the public street right-of-way(Public Works). Storm Drain Area Fee: Prior to issuance of any building permits for the site, the applicant shall pay any unpaid drainage area fees. Grading and Drainage Plan: Prior to issuance of any building permits for the site, the applicant shall conduct hydrology studies as necessary, prepare grading and drainage plan, and pay fees required to obtain necessary grading and drainage permit.(PW) Street Improvement Agreement: Prior to issuance of any building permits for the site, execute a secured deferred street improvement agreement and post securities to guarantee the installation of the required street improvements, when called upon to do so by the City Engineer. Said agreement will be recorded and will require the property owner to cause plans for public improvements to be prepared by a registered civil engineer, pay fees, post securities, execute agreement(s), and provide insurance necessary to obtain an encroachment permit for construction of City standard improvements or join an assessment district, as required by the City Engineer (PW). Completion of Public Street Improvements: Public street improvements required by the secured deferred street improvement agreement must be completed and accepted by the City Engineer and the applicant must provide the one-year maintenance security, within 12 months from being called upon to do so by the City Engineer.(PW) Water Meters and Sewer Cleanouts: All water meters and sewer clean-outs shall be installed on private property.(PW) Underground Utilities: All new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions (PW). Utility Plan: Applicant shall submit a Utility Coordination Plan and Schedule for approval by the City Engineer for installation of all utilities. The plan shall minimize the damage to all public utilities. (PW) Title Report: Provide a current Preliminary Title Report.(Public Works) Storm Water Management: Comply with California Storm Water Best Management Practices Handbook, prepared by Storm Water Quality Task Force, Santa Clara Valley Water District.(PW) Planning Commission Resolution No. 3096 S 97-12 - 1282 Burrows Road Page 4 17. 18. 19. 20. 21. 22. Coordination with Capital Improvement/Other Projects: Construction and traffic control shall be coordinated with the City capital improvement projects, if any (PW). Flagged Lots: Flag Lots shall conform with all access and water supply requirements in accordance with Fire Code Article 9. Contact Fire Department for applicable means of compliance (County Fire Department) Fire Apparatus (Engine) Access Driveway Required: Provide an access driveway with a paved all weather surface and minimum unobstructed width of 12 feet, vertical clearance of 13 feet 6 inches, minimum circulating turning radius of 36 feet outside and 23 feet inside, and a maximum slope of 15%. Installations shall conform to Fire Department Standard Details and Specifications D-I.(CFD) Fire Department (Engine) Driveway Turn-around Required: Provide an approved fire department engine driveway turnaround with a minimum radius of 36 feet outside and 23 feet inside. Installations shall conform with Fire department Standard Details and Specifications D-1. (CFD) Required Access to Water Supply (Hydrants): Portions of the structure are greater than 150 feet of travel distance from the centerline of the roadway containing public fire hydrants. Provide an on-site fire hydrant or provide an approved residential fire sprinkler throughout all portions of the building.(CDF) Development Approval Expiration: The Site and Architectural approvals for this project is valid for a period of one year from the Planning Commission approval.
