PC Res 3100RESOLUTION NO. 3100 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, APPROVING A TENTATIVE PARCEL MAP TO ALLOW THE CREATION OF A REAR FLAG ON PROPERTY LOCATED AT 1434 CAPRI DRIVE IN AN R-l-10 (SINGLE FAMILY RESIDENTAL) ZONING DISTRICT. APPLICATION OF MR. JOHN TOWNSEND. FILE NO. PM 97-04. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows with respect to application PM 97-04: The proposed land division creating two (2) lots results in a density of 3.18 units per gross acre. This density is consistent with the Low Density Residential land use designation of less than 3.5 units per gross acre for the subject site as shown on the Land Use Element of the General Plan. The size of each parcel, and its dimensions, meet the requirements for the R-1-10 (Single family residential) zoning district, the standards of the San Tomas Area Neighborhood Plan and the standards for creation of a rear flag lot. o The shape and size of the lots are consistent with those of other lots in the neighborhood, and the pattern of the lots are similar to other rear flag lot configurations, including that of the neighboring property to the south. ° The project has been reviewed by public agencies and utility companies and meets the requirements of the City and the Santa Clara County Central Fire District. o The project qualifies as a Class 15, Categorically Exempt project, per Section 15315 of the California Public Resources Code (California Environmental Quality Act). ° The project is designed to accommodate future development of a single family residence on the rear flag lot. Based on the foregoing findings of fact, the Planning Commission finds and concludes that: The proposed subdivision, subject to the Conditions of Approval, is consistent with the General Plan, the Zoning Ordinance and the Standards of the San Tomas Area Neighborhood Plan. Planning Commission Resolution No. 3100 PM 97-04 - 1434 Capri Drive - John Townsend Page 2 o The proposed subdivision does not impair the balance between the housing needs of the region and the public service needs of its residents and available fiscal and environmental resources. No substantial evidence has been presented which shows that the project, as presented and subject to the attached conditions, would have a significant effect upon the environment. No substantial evidence has been presented which shows that the project, as presented and subject to the attached conditions, would have a significant effect on the health, safety, or welfare of the neighborhood or community. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT 1. Approved Project: Approval is granted for a Tentative Parcel Map allowing the creation of two (2) single family residential lots on property located at 1434 Capri Drive. The map shall substantially conform to the map prepared by Steven Arnold, Civil Engineer, dated as received by the Planning Division on June 23, 1997, except as may be modified by the Conditions of Approval herein. Property Maintenance: The property shall be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures on the rear flag lot shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Park In-Lieu Fee: Applicant to pay a fee in-lieu of park dedication prior to recordation of the final subdivision map. Park Impact Fee: Applicant shall be advised that a park impact fee is required in addition to the Park In-Lieu Fee prior to occupancy of the single family residence to be constructed on the rear flag lot. o Building Approval: Approval of a Site and Architectural Review Permit by the Planning Commission is required for any new residence to be constructed on the lots prior to issuance of building permits. Planning Commission Resolution No. 3100 PM 97-04 - 1434 Capri Drive - John Townsend Page 3 6 Parking Requirement: Upon removal of the existing garage on the front lot (Parcel A), the applicant shall be required to provide two parking spaces (1 covered space and 1 uncovered space) on Parcel A prior to recordation of the Final Parcel Map. o Tree Protection Plan: Applicant to submit a tree protection plan for approval by the Community Development Director addressing retention of existing trees and replacement of removed trees consistent with the Water Efficient Landscaping Standards (WELS). PUBLIC WORKS DEPARTMENT 8. Standard Street Improvements: Capri Drive is classified as a minor collector and street improvements will be required in accordance with the San Tomas Area Neighborhood Plan. Prior to issuance of any building permits for the site, the applicant shall execute a secured deferred street improvement agreement to guarantee the installation of the required public street improvements. Public street improvements shall include the following: a. Concrete curb and gutter installed 18 feet from centerline. b. Asphaltic concrete pavement from concrete gutter to centerline plus additional width to conform to existing pavement. c. A 4.5 foot sidewalk adjacent to the curb. d. Street trees and irrigation at 40 feet on center installed behind the sidewalk. e. Storm drain improvements as determined by the City Engineer. f. Street lights will be required in accordance with the City's Street Lighting Policy and the San Tomas Area Neighborhood Plan. Grading and Drainage Plans: Prior to issuance of any grading or building permits for the site, the applicant shall conduct hydrology studies as necessary, prepare grading and drainage plans, and pay fees required to obtain necessary grading permits. 10. Parcel Map: Prior to issuance of any building permits for the site, the applicant shall prepare and submit a parcel map for review by the City Engineer and recordation upon City Engineer approval. Soils Report: The applicant shall provide a soils report prepared by a registered Geotechnical or Civil Engineer in order to determine the structural section of the pavement when the improvement plans are prepared as required by the City Engineer. 12. Title Report: The applicant shall provide a current Preliminary Title Report. 13 Storm Water Management: The applicant shall comply with California Storm Water Best Management Practices Handbook, prepared by Storm Water Quality Task Force, Santa Clara Valley Water District. 14. Monumentation: Prior to recording the parcel map, all monuments as shown on the final parcel map shall be set. Monuments destroyed during construction shall be reset prior to clearance for occupancy. 15. Storm Drain Area Fee: Prior to approval of the final parcel map, the applicant shall pay the then current storm drain area fee. The current fee is $2,000 per acre or $630 for this parcel. 16. Completion of Public Street Improvements: All public street improvements required by the encroachment permit must be completed and accepted by the City Engineer and the applicant must provide the one-year maintenance security. WEST VALLEY SANITATION DISTRICT 17. Connection Requirement: When the rear flag lot parcel is connected to the sewer, it will be required to have a separate 4 inch diameter sewer lateral for the single family lot. SANTA CLARA VALLEY WATER DISTRICT 18. Wells: In accordance District Ordinance 90-1, the owner should show any existing well(s) on the plans. The well(s) should be property registered with the District and either be maintained or abandoned in accordance with District standards.
