PC Res 3101RESOLUTION NO. 3101 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL GRANTING A SITE AND ARCHITECTURAL APPROVAL TO ALLOW THE CONSTRUCTION OF A NEW SINGLE-FAMILY HOME ON PROPERTY LOCATED AT 1434 CAPRI DRIVE IN AN R-l-10 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MR. JOHN TOWNSEND. FILE NO. S 97-14. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application S 97-14. The proposed project is consistent with the R- 1-10 (single family residential, 10,000 square foot minimum lot size) zoning district and development standards as required per the San Tomas Area Neighborhood Plan. 2. The proposed project is well designed and is architecturally compatible with the surrounding neighborhood and with the San Tomas Area Neighborhood Plan. o The development of the property will result in a density of 3.18 dwelling units per gross acre and is consistent with the General Plan density of less than 3.5 dwelling units per gross acre for this area. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project is consistent with the General Plan and the City's zoning ordinance. 2. The proposed project as conditioned will aid in the harmonious development of the immediate area. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions is in accordance with the ordinance of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: Planning Commission Resolution No. 3101 S 97-14 - 1434 Capri Drive - John Townsend Page 2 COMMUNITY DEVELOPMENT DEPARTMENT 1. Approved Project: Approval is granted for a Site and Architectural Review permit to allow construction of a new single family residence to be located at 1434 Capri Drive on a rear flag lot. Project approval shall substantially comply with project plans prepared by Gary Kohlsaat dated as received by the Community Development Department on June 19, 1997, except as modified by the Conditions of Approval herein. Exterior Elevations: The applicant shall apply alternative decorative elements on the exterior elevations to be reviewed and approved by the Community Development Director to differentiate the design of the proposed residence with the design of a residence approved for the adjacent rear flag lot to the south. A differentiation in color shall also be applied. o Final Parcel Map: This Site and Architectural Review Permit approval is contingent upon approval of the Tentative Parcel Map to divide the subject property. The final parcel map shall be approved and recorded prior to issuance of building permits for the construction of the new single family residence. Site and Architectural Approval Expiration: The Site and Architectural approval (S 97-14) of this project is valid for a period of one year from the Planning Commission approval. All conditions of approval specified herein must be completed within one year from the date of approval or the permit shall be void. Building Division Requirements: Applicant shall comply with all Building Code requirements and obtain necessary permits as determined by the City's Building Division. o Park Impact Fee: A park impact fee of $10,990 is due upon development of a new single- family residence. Full payment of this fee is due prior to issuance of a certificate of building occupancy. o Fences: Any newly proposed fencing shall comply with Section 21.59.090 of the Campbell Municipal Code. ° Property Maintenance: The property is to be maintained free of any combustible trash, debris and weeds until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property (Section 11.201 and 11.414, 1985 Ed. Uniform Fire Code). Parking and Driveways: All parking and driveway areas shall be developed in compliance with the standards in Chapter 21.50 of the Campbell Municipal Code. Tree Protection Plan: The applicant shall submit a tree protection plan in accordance with the City's Water Efficient Landscape Guidelines (WELS) to indicate how trees to be retained on site will be protected from construction, prior to issuance of building permits. CENTRAL FIRE DISTRICT: 11. Fire Sprinkler Requirements: Applicant will provide an approved residential fire sprinkler system throughout all portions of the residence and garage as agreed upon in a letter submitted to the Central Fire District dated June 17, 1997. 12. Fire Apparatus (Engine) Access Driveway Required: Provide an access driveway with a paved all weather surface and a minimum unobstructed width of 12 feet, vertical clearance of 13 feet 6 inches, minimum circulating radius of 36 feet outside and 23 feet inside, and a maximum slope of 15%. Installations shall conform to Fire Department Standard Details and Specifications D-1. PUBLIC WORKS DEPARTMENT 13. Standard Street Improvements: Capri Drive is classified as a minor collector and street improvements will be required in accordance with the San Tomas Area Neighborhood Plan. Prior to issuance of any building permits for the site, the applicant shall execute a secured deferred street improvement agreement to guarantee the installation of the required public street improvements. Public street improvements shall include the following: a. Concrete curb and gutter installed 18 feet from centerline. b. Asphaltic concrete pavement from concrete gutter to centerline plus additional width to conform to existing pavement. c. A 4.5 foot sidewalk adjacent to the curb. d. Street trees and irrigation at 40 feet on center installed behind the sidewalk. e. Storm drain improvements as determined by the City Engineer. f. Street lights will be required in accordance with the City's Street Lighting Policy and the San Tomas Area Neighborhood Plan. 14. Grading and Drainage Plans: Prior to issuance of any grading or building permits for the site, the applicant shall conduct hydrology studies as necessary, prepare grading and drainage plans, and pay fees required to obtain necessary grading permits. 15. Parcel Map: Prior to issuance of any building permits for the site, the applicant shall prepare and submit a parcel map for review by the City Engineer and recordation upon City Engineer approval. 16. Soils Report: The applicant shall provide a soils report prepared by a registered Geotechnical or Civil Engineer in order to determine the structural section of the pavement when the improvement plans are prepared as required by the City Engineer. Planning Commission Resolution No. 3101 S 97-14 - 1434 Capri Drive - John Townsend Page 3 17. Title Report: The applicant shall provide a current Preliminary Title Report. 18. Storm Water Management: The applicant shall comply with California Storm Water Best Management Practices Handbook, prepared by Storm Water Quality Task Force, Santa Clara Valley Water District. 19. Monumentation: Prior to recording the parcel map, all monuments as shown on the final parcel map shall be set. Monuments destroyed during construction shall be reset prior to clearance for occupancy. 20. Storm Drain Area Fee: Prior to approval of the final parcel map, the applicant shall pay the then current storm drain area fee. The current fee is $2,000 per acre or 630 for this parcel. 21. Completion of Public Street Improvements: All public street improvements required by the encroachment permit must be completed and accepted by the City Engineer and the applicant must provide the one-year maintenance security.
