PC Res 3105RESOLUTION NO. 3105 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A SITE AND ARCHITECTURAL APPLICATION TO ALLOW THE CONSTRUCTION OF A NEW SINGLE-FAMILY HOME ON PROPERTY LOCATED AT 1849 POLLARD ROAD IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MS. JOYCE KEALOHA. FILE NO. S 97-14. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application S 97-14. 1. Single family residences are permitted in other zones which are consistent with the Low- Medium General Plan designation. 2. Only one third of the acre sized parcel is developable due to a 75' wide PG&E easement; 3. The project is consistent with the San Tomas Neighborhood Plan design guidelines. 4. The proposed project is well designed and is architecturally compatible with the surrounding neighborhood. Based upon the foregoing findings of fact the Planning Commission further finds and concludes that: 1. The proposed development and uses clearly will result in a more desirable environment and use of the land than would be possible under any other zoning classification. 2. The development and proposed land use are compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. o The proposed development will not result in allowing more residential units than would be allowed by other residential zoning districts which are consistent with the general plan designation of the property; and 4. The proposed development will not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. Planning Commission Resolution No. 3105 S 97-14 - 1849 Pollard Road - Joyce Kealoha Page 2 The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions is in accordance with the ordinance of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: PUBLIC WORKS CONDITIONS: 1. Grading and Drainage Plan Prior to issuance of any grading, drainage or building permits for the site, the applicant shall conduct hydrology studies as necessary, prepare an ENGINEERED grading and drainage plan, and pay fees required to obtain necessary grading permit. The plans shall comply with the 1994 edition of the UBC including Chapters 18 and 33. Storm Drain Area Fee Prior to issuance of any grading, drainage or building permits for Phase I, the applicant shall pay the storm drain area fee of $2,500 per acre or $1,900 for the subject property. Underground Utilities All new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall provide evidence from all utility companies that the application as proposed can be served. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility company. Applicant shall submit a Utility Coordination Plan and Schedule for approval by the City Engineer for installation of all utilities. The Plan shall minimize the damage to all public facilities. Flood Controls Prior to issuance of any building permits the applicant shall obtain approval of the Santa Clara Valley Water District. Storm Water Management Comply with California Storm Water Best Management Practices Handbook, prepared by Storm Water Quality Task Force, Santa Clara Valley Water District. Planning Commission Resolution No. 3105 S 97-14 - 1849 Pollard Road - Joyce Kealoha Page 3 FIRE DEPARTMENT o Fire Apparatus (Engine) Access Driveway Required: Provide an access driveway with a paved all weather surface and minimum unobstructed width of 12 feet, vertical clearance of 13 feet 6 inches, minimum circulating turning radius of 36 feet outside and 23 feet inside, and a maximum slope of 15%. Installations shall conform to Fire Department Standard Details and Specifications D-1 .(CFD) Fire Department (Engine) Driveway Tm-around Required: Provide an approved fire department engine driveway turnaround with a minimum radius of 36 feet outside and 23 feet inside. Installations shall conform with Fire Department Standard Details and Specifications D-1. (CFD) o Required Access to Water Supply (Hydrants): Portions of the structure are greater than 150 feet of travel distance from the centerline of the roadway containing public fire hydrants. Provide an on-site fire hydrant or provide an approved residential fire sprinkler throughout all portions of the building.(CDF) BUILDING DIVISION 9. Firewall: Provide modified one (1) hour separation of garage from all other occupancies(UBC 302). PLANNING DIVISION 10. Development Approval Expiration: The Planned Development approval for this project is valid for a period of one year from the City Council approval.
