BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL APPROVING
THE REINSTATEMENT (R 97-05) OF A PREVIOUSLY-
APPROVED CONDITIONAL USE PERMIT TO ESTABLISH
A PEDIATRIC HOSPITAL ON PROPERTY LOCATED AT
3777 S. BASCOM AVENUE IN AN R-3-S (HIGH DENSITY
RESIDENTIAL) ZONING DISTRICT. APPLICATION OF
MR. MICHAEL ZARCONE. FILE NO. R 97-05.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application R 97-05:
1. The proposed use is similar to the use for which the site was designed, and which
operated previously on the site without detriment to the surrounding neighborhood.
The previous conditions of approval will continue as conditions of approval for the
proposed use, together with additional conditions of approval to revitalize the
landscaping.
3. The parking demand for the proposed use is similar to or less than that of the previous
use.
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:
1. The proposed project is consistent with the General Plan and the local zoning
ordinance, and;
2. The proposed project as conditioned will aid in the harmonious development of the
immediate area;
The establishment, maintenance or operation of the use applied for will not be
detrimental to the health, safety, peace, morals, comfort, or general welfare of persons
residing or working in the neighborhood of such proposed use, or be detrimental or
injurious to property and improvements in the neighborhood or to the general welfare
of the City.
The proposed site is of adequate shape and size to accommodate the yards, walls,
fences, screening, landscaping and other development features required in order to
integrate said use with uses in the surrounding area. The site will be maintained in
accordance with City laws and development standards.

The applicant is hereby notified, as part of this application, that he/she is required to
meet the following conditions is in accordance with the ordinance of the City of
Campbell and the State of California. Additionally, the applicant is hereby notified that
he/she is required to comply with all applicable Codes or Ordinances of the City of
Campbell and the State of California that pertain to this development and are not herein
specified:
Approved Project: This approval is for a reinstatement of a previous Conditional Use
Permit (UP 88-01) and Modification (M 89-20) allowing construction and operation
of a hospital. The proposed use shall substantially conform to the description in the
applicant's letter dated May 7, 1997, and the proposed plan with the plans approved
under the previous approvals, except as modified by the conditions herein.
Previous Conditions:
All conditions of approval of the original use permit as approved by Resolution No.
2520 for UP 88-01 shall remain in effect, except as modified by conditions herein.

Landscaping:
A. A landscaping plan including the originally approved landscaping plan, and those
changes proposed, shall be submitted to the City Planning Division staff for
review and approval.
B. Barren areas, in which the landscaping has either died or significantly
deteriorated, shall be indicated for replanting in the landscaping plan.
C. New plants indicated on the landscaping plan shall be installed, and the irrigation
lines demonstrated as being fully functional, prior to occupancy of the facility.
Street Trees:
The applicant shall remove the existing shrub located in the most northerly tree well,
and plant a 15 gallon tree of the same variety as the other existing street trees. An
Encroachment Permit shall be obtained prior to commencement of this work, and the
replacement shall be planted and irrigated to meet the City Street Tree Planting,
Staking and Irrigation Details.
Underground Utilities:
All new on-site utilities shall be installed underground per Section 20.36.150 of the
Campbell Municipal Code. Applicant shall comply with all plans submittals,
permitting and fee requirements of the serving utility company.

Rooftop and on-site Mechanical Equipment:
Plans for any new equipment which has any portion outside the building, whether on
the ground, on top of or attached to the building, shall be submitted to the City for
review and approval by the Building and Planning Divisions.
Signs:
Any proposed exterior signs or sign changes shall be submitted to the City Planning
Division for review and approval.
Trash Management:
The lids of all trash containers shall be kept closed except when filling or emptying
them. Arrangement shall be made for the timely removal of all trash.
