PC Res 2135RESOLUTION NO. 2135
PLANNING COMMISSION
After notification and public hearing as specified by law on proposed amendment
to the text of Chapter 21.07 -- CD (Condominium Zoning District) of the Campbell
Municipal Code, and after presentation by the Planning Director, proponents and
opponents, the hearing was closed (TA 82-03).
After due consideration of all evidence presented and based upon the following
findings, the Commission did determine that there was a significant need to
amende Chapter 21.07 -- CD (Condominum Zoning District) of the Campbell
Municipal Code:
1. The proposed amendment will provide a procedure for the conversion
of existing multiple family rental housing units to condominiums,
community apartments, stock co-operatives, and any other subdivision
which is a conversion of existing rental housing,
2. That the proposed amendment is not intended to encourage or
discourage the conversion of existing rental housing to
condominiums, rather it is the purpose of this district to
assure that the City has an opportunity to review each
application to determine the impact of a conversion with
regard to the goals and policies expressed in the General
Plan of the City of Campbell.
3. That the proposed amendment will not be detrimental to the
health, safety, peace, morals, comfort, orgeneral welfare
of persons residing or working in the neighborhood of such
proposed use, or be detrimental or injurious to property
and improvements in the neighborhood or to the general
welfare of the City.
The Planning Commission does hereby recommend that the City Council adopt
the ordinance attached hereto as Exhibit A enacting the necessary legis-
lation to make the proposed text amendment effective.
