PC Res 2127RESOLUTION NO. 2127 PLANNING COMMISSION After notification and public hearing as specified by law on the application of Mr. Joseph Guinta for a use permit to allow the establishment of a flea market the second weekend of each month in the parking lot of property known as 1739-1783 S. Winchester Blvd. (Campbell Center Shopping Center) in a C-2-S (General Commercial) Zoning District, as per application filed in the Office of the Planning Department on June 30, 1982, and after presentation by the Planning Director, proponents and opponents, the hearing was closed (UP 82-14). After due consideration of all evidence presented, the Commission did find as follows: That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such use, or be detrimental or injurious to the property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit subject to the following conditions: 1. Flea market sale area shall be limited to areas as indicated in Exhibit A. 2. Flea market to be operated a maximum of one Saturday per month between the hours of 9 a.m. and sunset. 3. Provisions satisfactory to the Fire Chief and Planning Director shall be provided for handling trash during and after days of operation. 4. Provision satisfactory to the Public Works Director and Planning Director shall be provided limiting the extent of the sales area and access points to the flea market area. 5. Any signing shall be erected in conformance with Chapter 21.68 of the Campbell Municipal Code. 6. This use permit shall be reviewed by the Planning Commission on a six-month basis following its approval. 7. The applicant shall obtain a business license for a temporary vendor for each day of operation. The applicant is notified as part of this application that he is required to comply with all applicable Codes or Ordinances of the City of Campbell and Laws of the State of California which pertain to this request and are not herein specified.
