PC Res 2100PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA RESOLUTION N0. 2100 After notification and public hearing as specified by law on the application of Mr. Jeffry Callin fora use permit to allow the establishment; of an off-sale beer and wine eating place on property known as 819 W. Hamilton Avenue in a PD (Planned Development/Commercial) Zoning District, as per the application filed in the Office of the Planning Department on February 10, 1982, and after presentation by the Planning Director, proponents and opponents, the hearing was closed (UP 82-03). After due consideration of all the evidence presented, the Commission did find as follows: That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit subject to the following conditions: 1. Seating shall be limited to 18 seats. 2. Applicant shall obtain a sign permit prior to the erection of any signs. 3. FIRE DEPARTMENT: Provide 2A-IOBC fire extinguisher. 4. BUILDING DEPARTMENT: If any interior partitions are to be installed, a building permit will be required. The applicant is notified as part of this application that he is required to comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. USE PERMIT SHALL NOT BECOME EFFECTIVE UNTIL RATIFIED BY THE CITY COUNCIL.
