PC Res 3126RESOLUTION NO. 3126 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE PLACEMENT OF CELLULAR ANTENNAS ON AN EXISTING PG&E TRANSMISSION TOWER ON PROPERTY LOCATED AT CREEKSIDE WAY AND HAMILTON AVENUE IN A PF (PUBLIC FACILITIES) ZONING DISTRICT. APPLICATION OF MR. RAYMOND HASHIMOTO, ON BEHALF OF GTE MOBILNET. FILE NO. UP 97-14. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application UP 97-14: Public service facilities are permitted in the Public Facilities Zoning District subject to the approval of a conditional use permit. The installation of cellular antennas at an existing PG & E substation is compatible with the existing uses on the site. o The existing landscaping on the site does not adequately screen the existing or proposed use from public view. A condition of approval requiring supplemental landscaping including trees along the frontage of the property will provide reasonable screening of the antennas and the transmission tower. o Additional landscaping to the site will improve the appearance of the property from Hamilton and Bascom Avenues which is consistent with the goals of the Community Design Study of enhancing Campbell's community image. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project is consistent with the General Plan and the local zoning ordinance. 2. The proposed project as conditioned will aid in the harmonious development of the immediate area. o The establishment, maintenance or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Planning Commission Resolution No. 3126 UP 97-14 - Creekside Way and Hamilton Avenue - GTE Mobilnet Page 2 The proposed site is of adequate Shape and size to accommodate the yards, walls, fences, screening, landscaping and other development features required in order to integrate said use with uses in the surrounding area. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: Approved Project: Approval is granted for a Use Permit allowing for the installation of four (4) cellular antennas and a ground level equipment facility on property located at the PG & E substation at Creekside Way and Hamilton Avenue. Project approval shall substantially comply with project plans prepared by Delta Groups Engineering, Inc. dated 9/17/97, except as modified herein in the Conditions of Approval. 2. Permits: Applicant shall obtain any permits deemed necessary by the Building Official or the Uniform Building Code. Landscaping: Applicant shall submit four (4) sets of a landscaping plan indicating, 24" box Redwood trees planted 20 feet on-center, to supplement the existing landscaping along the northern and eastern perimeter of the property. The placement of trees shall be located to reasonably screen the transformers and transmission tower from view from Creekside Way, Hamilton Avenue, and Bascom Avenue. Landscaping for the area surrounding the ground mounted equipment enclosure shall be installed if it is visible from the public view. Planting details and the irrigation system shall be submitted to the Community Development Department for review and approval prior to the issuance of building permits. Development Approval Expiration: The Use Permit approval (LIP 97-14) for this project is valid for a period of one year from the Planning Commission approval. All conditions of approval specified herein must be completed within one year from the date of approval or the Use permit shall be void. Review of Approval: This approval is effective for five years. The owner or owner's representative will revisit the Use Permit application every five years to determine that the equipment is consistent with current technology of new installations at that time and is visually less obtrusive as compared with what is in place at this time. The applicant should apply for renewal 90 days prior to the expiration of this approval, or by July 28, 2002.
