After notification and public hearing as specified by law on the
application of Mr. Michael Segal for a use permit to allow the conversion
of a four-plex apartment to a residential care home on property known as
599 W. Sunnyoaks Avenue in an R-2-S (Multiple Family Residential) Zoning
District, as per application filed in the office of the Planning Department
on September 8, 1981, and after presentation by the Planning Director,
proponents and opponents, the hearing was closed (UP 81-14 .
After due consideration of all evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation of the proposed
use will not be detrimental to the health, safety, peace, morals,
comfort, or general welfare of persons residing or working in the
neighborhood of such use, or be detrimental or injurious to the
property and improvements in the neighborhood or the general
welfare of the City.
Based on the above findings, the Planning Commission does hereby grant
the requested use permit subject to the following conditions:
1. Resurface and stripe parking area as per City standards.
Z. Provide trash enclosure as per approval of Planning Director
and Fire Department.
3. Use permit subject to review in one year to insure adequacy
of parking.
4. Change of occupancy from an apartment building to a nursing '
home with nonambulatory patients (I-1) shall require building
to be brought up to 1979 Building Code standards. Sect. 502
5. Non-ambulatory guests to be housed on lower floor with all
rooms fitted for handicapped persons.
6. Provide an automatic fire extinguishing system throughout.
7. Provide smoke detectors in each sleeping area.
8. Obtain a Permit to Operate an Institutional Occupancy (more than 5).
9. All sleeping rooms must have direct or semi-direct exiting to the
exterior of the building.
10. Provide 2A-IOBC fire extinguishers.
The applicant is notified that he shall comply with all applicable a
Codes or Ordinances of the City of Campbell which pertain to this k
development and are not herein specified.
