PC Res 2046RESOLUTION N0. 2046 PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA After notifcation and public hearing as specified by law on proposed amendments to the text of the Campbell Punicipal Code, adding Chapter 21.59 - Garage Conversions, and after presentation by the Planning Director, proponents and opponents, the hearing was closed (TA 81-1). After due consideration of all evidence presented and based upon the following findings, the Commission did determine that there was a significant need to amend the Campbell Municipal Code by adding Chapter 21.69 - Garage Conversions: 1. That the proposed amendment will make a conversion of a garage and/or carport to additional living space require approval of a Conditional Use Permit and Architectural Approval by the Planning Commission. 2. That the proposed amendment would give the Planning Commission additional control over conversions and would also give property owners in the immediate area notice and an opportunity to comment on the conversion. 3. That the proposed amendment is also intended to permit garage conversions where they would be otherwise prohibited. More specifically, although the ordinance requires two on-site parking spaces, the Planning Commission, under Section 21.50.040 of the C.M.C., has the authority to adjust the parking require- ments, or in this case to waive the requirement that the parking be covered. 4. That the proposed amendment would allow the examination of potential conversions on an individual basis, and after input from the surrounding property owners, if the Commission finds that the conversion would not be detrimental to the neighborhood or the City, it could be allowed. 5. That the proposed amendment will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons re- siding or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The Planning Commission does hereby recommend that the City Council adopt the ordinance attached hereto as Exhibit A enacting the necessary legislation to make the proposed text amendment effective.
