BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL GRANTING A SITE AND
ARCHITECTURAL APPROVAL (S 97-21) TO ALLOW THE
CONSTRUCTION OF A 3,002 SQUARE FOOT, TWO-STORY,
SINGLE-FAMILY RESIDENCE ON A FLAG LOT ON
PROPERTY LOCATED AT 1775 W. HACIENDA AVENUE IN
AN R-l-9 (SINGLE FAMILY RESIDENTIAL) ZONING
DISTRICT. APPLICATION OF MR. OMID SHAKERI. FILE NO.
S 97-21.
After notification and public hearing, as specified by law, and after presentation by the
Commtmity Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application S 97-21.
The proposed project is consistent with the R-l-9 (single family residential, 9,000 square foot
minimum lot size) zoning district and development standards as required per the Zoning
Ordinance and the San Tomas Area Neighborhood Plan, with approval of a final parcel map
to create the rear (flag) lot in accordance with the Tentative Parcel Map approval granted on
September 29, 1997.
2. The proposed project is well designed and is architecturally compatible with the surrounding
neighborhood and with the San Tomas Area.

The development of the property will result in a density of 3.51 dwelling units per gross acre
and is consistent with the General Plan density of less than 4.5 dwelling units per gross acre
for this area.
Based upon the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed project is consistent with the City's General Plan, Zoning Ordinance and San
Tomas Area Neighborhood Plan.
2. The proposed project as conditioned will aid in the harmonious development of the
immediate area.
The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions is in accordance with the ordinance of the City of Campbell and the State of
California. Additionally, the applicant is hereby notified that he/she is required to comply with
all applicable Codes or Ordinances of the City of Campbell and the State of California that
pertain to this development and are not herein specified:

1. Approved Project: Approval is granted for a Site and Architectural Review permit to allow
construction of a new 3,002 square foot, two-story, single family residence with an
attached 732 square foot three-car garage to be located on a rear (flag) lot on property
currently located at 1775 W. Hacienda Avenue. Project approval shall substantially
comply with project plans prepared by Roaten Hinson Associates dated as received by the
Community Development Department on October 14, 1997, except as modified by the
Conditions of Approval herein.
Final Parcel Map: This Site and Architectural Review Permit approval is contingent upon
approval of a final parcel map to divide the subject property in accordance with the
Tentative Parcel Map approved on September 29, 1997. The final parcel map shall be
approved and recorded prior to issuance of building permits for the construction of the new
single family residence.

Site and Architectural Approval Expiration: The Site and Architectural approval (S 97-21)
of this project is valid for a period of one year from the Planning Commission approval.
All conditions of approval specified herein must be completed within one year from the
date of approval or the permit shall be void.
Building Division Requirements: Applicant shall comply with all Building Code
requirements and obtain necessary permits as determined by the City's Building Division.

Park Impact Fee: A park impact fee of $10,990 is due upon development of a new single-
family residence. Full payment of this fee is due prior to issuance of a certificate of
building occupancy.

Fences: Any newly proposed fencing shall comply with Section 21.59.090 of the
Campbell Municipal Code.
Property Maintenance: The property is to be maintained free of any combustible trash,
debris and weeds until the time that actual construction commences. All existing structures
shall be secured by having windows boarded up and doors sealed shut, or be demolished or
removed from the property (Section 11.201 and 11.414, 1985 Ed. Uniform Fire Code).

Parking and Driveways: All parking and driveway areas shall be developed in compliance
with the standards in Chapter 21.50 of the Campbell Municipal Code.
Tree Protection Plan: The applicant shall submit a tree protection plan in accordance with
the City's Water Efficient Landscape Guidelines (WELS) to indicate how trees to be
retained on site will be protected from construction, prior to issuance of building permits.

Landscaping: The applicant shall be required to plant four (4) new trees along the westem
property line to provide privacy screening for adjacent properties, in addition to
maintaining the three (3) existing trees along the eastern property line. The applicant shall
provide a landscape plan to the Community Development Department, showing the
location, type and size of the four (4) new trees to be planted, for review and approval by
the Community Development Director and the homeowner's association of the adjacent
townhouse development, prior to issuance of building permits.
San Tomas Area Neighborhood Plan: The approved project shall comply with all
requirements of the City's San Tomas Area Neighborhood Plan.
CENTRAL FIRE DISTRICT:
12. Property Address: Applicant shall provide the Central Fire District with the newly
established address to be assigned to the property prior to issuance of building permits.

Development Review: Review of this development proposal is limited to acceptability of
site access and water supply as they pertain to Fire Department operations, and shall not be
construed as a substitute for formal plan review to determine compliance with adopted
model codes. Prior to performing any work, the applicant shall apply to the City's
Building Division for applicable construction permits.

Required Fire Flow: Required fire flow for this project is 1000 GPM at 20 psi residual
pressure. The required fire flow is available from area water mains and fire hydrant(s)
which are spaced at the required spacing.
15.
Required Access to Water Supply (Hydrants): Portions of the structure(s) are greater than
150 feet of travel distance from the centerline of the roadway containing public fire
hydrants. Provide an on-site fire hydrant OR provide an approved residential fire sprinkler
system throughout all portions of the building.
16.
Fire Apparatus (Engine) Access Driveway Required: Provide an access driveway with a
paved all weather surface and a minimum unobstructed width of 12 feet, vertical clearance
of 13 feet 6 inches, minimum circulating turning radius of 36 feet outside and 23 feet
inside, and a maximum slope of 15%. Installations shall conform to Fire Department
Standard Details and Specifications D-1.
17.
Timing of Required Roadway/Driveway Installations: Required roadway/driveway
installations shall be in place, inspected, and accepted by the Fire Department prior to the
start of construction. Bulk combustible construction materials may not be delivered to the
construction site until installations are completed as stated above. Clearance for building
permits also may be held until installations are completed.

18. Compliance with Tentative Parcel Map approvals: The applicant shall comply with all
Conditions of Approval for the Tentative Parcel Map (PM 97-07) as approved during an
Administrative Hearing on September 29, 1997. All of the said Tentative Parcel Map
Conditions of Approval apply to both Parcel A and Parcel B of the said Tentative Parcel
Map (PM 97-07).
