After notification and public hearing as specified by law on the
application of Mr. Warren Jacobsen, A.I.A., for a use permit and approval
of plans and elevations to convert an existing service station into a
retail sales building while retaining the service bays for the sale of
gasoline on property known as 1387 Camden Avenue in a C-1-S (Neighborhood
Commercial) Zoning District, as per application filed in the Office of
the Planning Department on March 11, 1981, and after presentation by the
Planning Director, proponents and opponents, the hearing was closed
(UP 81-06).
After due consideration of all evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation of the
proposed use will be detrimental to the health, safety,
peace, morals, comfort or general welfare of persons
residing or working in the neighborhood of such use, or
be detrimental or injurious to the property and improve-
ments in the neighborhood or the general welfare of the
City.
That the use of 975 square feet of the building to sell
clothing is not incidental to the service station use.
That it has been the past policy of the Planning
Commission and the City Council to not allow expansion
of uses which are not related to the primary use.
Based on the above findings, the Planning Commission does hereby
recommend denial of the requested use permit.
