CC Resolution 11165RESOLUTION NO. 11165 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING AN EXTENSION OF APPROVAL (PLN2010-18) OF A PREVIOUSLY APPROVED PLANNED DEVELOPMENT PERMIT (PLN2007-111) TO ALLOW THE CONSTRUCTION OF A NEW SINGLE- FAMILY RESIDENCE AND THE REMODEL OF AN EXISTING SINGLE FAMILY RESIDENCE ON PROPERTY CURRENTLY APPROVED FOR A LOT SPLIT OWNED BY MR. GREGORY WHITESIDE LOCATED AT 190 SUNNYSIDE AVENUE IN A P-D (PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MR. GREGORY WHITESIDE. FILE NO: PLN2010-18. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The City Council finds as follows with regard to File No. PLN2010-18: Environmental Finding 1. The project qualifies as a Categorically Exempt project per Section 15303, Class 3 of the California Environmental Quality Act (CEQA) pertaining to new construction or conversion of small structures. Evidentiary Findings 1. The project site is currently developed with asingle-family home, which would be remodeled as part of this project. A detached garage was demolished in February 2010, as a Condition of Approval in preparation of the recordation of the Parcel Map. 2. The subject property is located on the south side of Sunnyside Avenue, west of the intersection First Street and Sunnyside Avenue, and is surrounded by residential uses on all sides. 3. The Zoning District for this property is P-D (Planned Development). 4. The General Plan land use designation for this property is Low-Medium Density Residential. 5. The density of the proposed project site is 8.7 units per gross acre, which is consistent with the General Plan land use designation of Low-Medium Density Residential (6-13 units per gross acre). 6. The proposed project is consistent with the Planned Development (P-D) Zoning Ordinance. City Council Resolution PLN2010-18 - 190 Sunnyside Avenue -Extension of Approval - PD Permit Paae 2 7. The site plan proposes the construction of one single family residence and remodel of an existing single family residence, each on individual lots. Each residence would take vehicular access from a separate driveway off Sunnyside Avenue. 8. The project provides a total of 8 parking spaces, where 4 spaces are required. 9. The completed project would consist of two single family residences with a combined building coverage of 41 %, landscaping coverage of 34%, and paving coverage of 25%. 10. The proposed project will have a combined floor area ratio of 0.62. 11. The conceptual landscape plan provides for the planting of trees, shrubs and grass to be planted. The proposed landscaping represents 34% of the combined total lot area. 12. The project was originally approved by the City Council as a Planned Development Permit (PLN2007-111) on March 18, 2008 by City Council Resolution No. 10886. 13. The Conditions of Approval of this Extension of Approval will incorporate and supersede the Conditions of Approval of past City development permits. 14. The unforeseen collapse of the economy has depressed the market for construction loans for residential projects throughout the Silicon Valley. 15. The applicant is seeking a 2-year extension of the project approval. The applicant's statement of justification describes the great difficulty of obtaining the financing necessary to complete the project. 16. Campbell Municipal Code Section 21.56.030 allows the decision-making body to approve an extension of approval for any period of time deemed commensurate with the justification for the extension as allowed by the Conditions of Approval. However, this section also sets a standard of 24-month increments for extensions of approval. 17. Incremental extensions of approval permit the City to ensure continued compliance with the Municipal Code. 18. The applicant has made a good faith effort to complete the final map process but is unable to secure the necessary signatures from the mortgage lender to record the map. 19. The Planning Commission reviewed this project at a regularly scheduled public meeting and forwarded a recommendation to approve the extension request. City Council Resolution PLN2010-18 - 190 Sunnyside Avenue -Extension of Approval - PD Permit Page 3 Based upon the foregoing findings of fact, the City Council further finds and concludes that: 1. The applicant has established, with substantial evidence, that a good faith effort to fulfill all the requirements of the permit approval has been made. 2. The applicant has, furthermore, with substantial evidence, provided justification for extension of the permit. THEREFORE, BE IT RESOLVED that the City Council approves an Extension of Approval (PLN2010-18) of a previously approved Planned Development Permit (PLN2007-111) to allow the construction of a new single family residence and the remodel of an existing single family residence on property currently approved for a lot split owned by Mr. Gregory Whiteside located at 190 Sunnyside Avenue in a P-D (Planned Development) Zoning District. Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division: 1. Declaration of Acceptance of All Conditions: Within thirty (30) days of the effective date of City Council approval, applicant shall sign the final, approved set of Conditions of Approval. Until said Conditions are signed, the approved Extension of Approval shall not be valid for any permits sought from the City. 2. Approved Project: Approval is granted for an Extension of Approval (PLN2010-18) of a previously approved and modified Planned Development (PLN2007-111), to allow the construction of a new single family residence and major remodel of an existing single family residence located at 190 Sunnyside Avenue. The building design and site design shall substantially conform to the project exhibits listed below, except as may be modified by the conditions of approval herein: City Council Resolution PLN2010-18 - 190 Sunnyside Avenue -Extension of Approval - PD Permit Page 4 a. Project plans prepared by Steve Nelson and stamped as received by the Planning Division on February 11, 2010. b. Tentative Parcel Map prepared by Argonaut Engineering and stamped as received by the Planning Division an January 30, 2008. c. Colored elevation and material board submitted by Gregory Whiteside and stamped as received by the Planning Division on January 30, 2008. 3. Supersession of Previous Conditions of Approvals: Upon the effective date of the Resolution approving this Extension of Approval (PLN2010-18), all Conditions of Approval specified by previously approved City development permits (PLN2007- 111), herein incorporated in full, shall be void and shall permanently be superseded in their entirety by these Conditions of Approval. 4. Approval Expiration: The Planned Development Permit approval shall be valid until March 18, 2012. Before or by this date a building permit for both structures must be obtained. Failure to obtain a building permit will result in the Planned Development Permit being void. An application for an Extension of Approval shall be received no less than 30 days prior to the approval expiration date. 5. Planning Final Required: Planning sign off is required prior to building permit final for each of the two residences. Construction not in substantial compliance with the approved project plans shall not be approved without prior authorization of the necessary approving body. 6. Parcel Map: The Planned Development Permit approval is contingent upon recordation of the Parcel Map to dividle the subject property. The Parcel Map shall be recorded prior to the issuance of building permits. 7. Administrative Planned Development Permit: After such time as the Parcel Map has been recorded creating two legal residential parcels, any modification to the approved architectural plans for either the remodel of the existing residence located on the front lot or the construction of the new residence to be located on the rear lot, not resulting in additional square footage, increase in building height, or decrease of any approved setback, may be approved through an Administrative Planned Development Permit. Any modification of the approved plans resulting in increased square footage, increase in building height or a reduction in an approved setback will require approval of a Modification to the previously approved Planned Development Permit. 8. Elevation Heights: Revise all praposed elevations to show the following measurements. Note: All measurement must be in actual values as well as elevation benchmark levels. Maximum structure height from finished grade d. Finished floor e. Plate Height (from finished grade, not finished floor) 9. Maximum Height: The maximum height of any residential structure on either the current parcel or the newly created parcels resulting from the lot split shall comply with the approved project plans as measured from existing grade. Any increase in site grade shall result in a decrease in building height so that the total height (building plus finished grade height) shall not exceed the maximum height shown on the approved plans (25' 7.5" for the proposed front lot and 25' 8" for the proposed rear lot). 10. Privacy Impacts: Obscure glass on all second story bathroom windows shall be incorporated into the project design. The applicant shall submit a materials sample, prior to the issuance of building permits, for review and approval by the Community Development Director. 11. Easements: Upon recordation of the Parcel Map, the applicant shall cause Easements to be recorded as shown on the approved Tentative Parcel Map for private utilities, private storm drains, reciprocal ingress and egress, etc. 12. Park Impact Fee: The applicant shall pay the current park impact fee, based on a density range of six to thirteen units pier gross acre, for the development of the site. Prior to recordation of the Parcel Map,. 75% of this fee is due and the remaining 25% is due prior to issuance of a certificate of building occupancy. 13. Landscape and Irrigation Plan: The .applicant shall submit a final landscape and irrigation plan to the Planning Division, prior to the issuance of building permits, for review and approval by the Community Development Director. The landscape and irrigation plan shall substantially confprm with the approved conceptual landscape plan and the City's 2010 Water Efficient Landscaping Standards (WELS). 14. Tree Protection Plan: The applicant shall submit a tree protection plan for all protected trees to be retained on site or on adjacent lots that are impacted by the project, and shall contain specific information about the preservation of the trees during any grading or building on site. Such tree protection measures shall be installed prior to any demolition, grading, or building on the project site. No construction or trenching shall take place within the drip line of trees and a fence constructed of temporary cyclone fencing or wire mesh securely attached to poles driven into the ground shall be installed around the dripline of the tree. All trimming or branch removal from protected trees shall be completed by a certified arborist. The tree protection plan shall be submitted to the Planning Division for review and City Council Resolution PLN2010-18 - 190 Sunnyside Avenue -Extension of Approval - PD Permit Page 6 approval by the Community Development Director prior to the issuance of building permits. 15. Fences: All new fencing shall be agood-neighbor style wood fence and shall comply with all the provisions of Section 21.18.060 of the Campbell Municipal Code. The design and location of all fences shall be reviewed and approved by the Community Development Director prier to issuance of any building permits for the project. Fencing along the property lines shall be replaced at the expense of the applicant/developer, unless it is determined to be in good condition by the Community Development Director. 16. Property Maintenance: The property is to be maintained free of any combustible trash, debris, and weeds until the time that actual construction commences. Any vacant existing structures shall be secured, by having windows boarded up and doors sealed shut, or be demolished oar removed from the property. 17. Utility Boxes and Back-Flow Prevent~rs: The applicant shall submit a plan prior to installation of PG&E utility (transformer) boxes and San Jose Water Company back- flow preventers, indicating the location of the boxes and screening (if the boxes are above ground) for approval by the Community Development Director. 18.On-Site Lighting: On-site lighting shaill be shielded away from adjacent properties and directed on site. The design and type of lighting fixtures and lighting intensity of any proposed exterior lighting for the project shall be reviewed and approved by the Community Development Director prior to installation of the lighting for compliance with all applicable Conditions of Ppproval, ordinances, laws and regulations. Lighting fixtures shall be of a decorative design to be compatible with the residential development and shall incorporate energy saving features. 19. Roof Vents: The applicant shall coordinate mechanical and plumbing plans to minimize the number of roof vents that are visible from the street frontage. The applicant shall provide the location of such vents on the building plan elevations and roof plans, to the satisfaction of the Community Development Director, prior to issuance of building permits. 20. Construction Activities: The applicant shall abide by the following requirements during construction: a. Construction activities shall be limited to weekdays between 8:00 a.m. and 5:00 p.m. and Saturdays between 9:00 ra.m. and 4:00 p.m. No construction shall take place on Sundays or holidays unlless an exception is granted by the Building Official b. Truck routes to and from the construction site should be established and submitted to the City for review and approval prior to issuance of a building City Council Resolution PLN2010-18 - 190 Sunnyside Avenue -Extension of Approval - PD Permit Paae 7 permit. These truck routes shall avoid access to the project site via residential streets where possible. c. All construction equipment with inteernal combustion engines used on the project site shall be properly muffled and nnaintained in good working condition. d. Unnecessary idling of internal combustion engines shall be strictly prohibited. e. All stationary noise-generating construction equipment, such as air compressors and portable power generators, slhall be located as far as possible from noise- sensitive receptors such as existing residences and businesses. f. Prior to the issuance of building permits, the project site shall be posted with the name and contact number of thej lead contractor and construction hours in a location visible from the public strut so that the contractor can be made aware of noise complaints. g. Construction equipment, vehicles, ,and workers associated with the development of the project shall not be permitte to park on any residential streets. h. Use dust-proof chutes for loading construction debris onto trucks. i. Water or cover stockpiles of debris soil, and other materials that can be blown by the wind. j. Cover all trucks hauling soil, sand, and other loose materials or require all trucks to maintain at least two feet of freet~oard. k. Sweep daily (with water sweepersl) all paved access roads, parking areas, and staging areas at the construction side. I. Sweep streets daily (with water svVeepers) if visible soil material is carried onto adjacent public streets, as directed Iby the City Engineer. m. Enclose, cover, water twice daily or, or apply (non-toxic) soil stabilizers to exposed stockpiles (dirt, sand, etc.. 21. Parking and Driveways: a. All parking and driveway areas shall be developed in compliance with the approved plans and Chapter 21.,28 (Parking and Loading) of the Campbell Municipal Code. b. The applicant shall provide a decprative pavement material for the driveways, uncovered parking spaces, and Mralkways for the project. The design and material to be used for the decorative pavement shall be indicated on the building permit plans and will be reviewed and approved by the Community Development Director prior to the issuance of building permits. Building Division: 22. Permits Reauired: A separate building permit application shall be required for each proposed new single family dwelling end the complete remodeling and addition to the existing structure. Tl~e building permits shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. Soils Report: Two copies of a current) soils report, prepared to the satisfaction of the Building Official, containing foundation and retaining wall design recommendations shall be submitted with the building permit application. This report shall be prepared by a licensed engineer specializing in foils mechanics. 24. Plan Preparation: Portions of this pro~ect require plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 25. Construction Plans: The conditions c}f Approval shall be stated in full on the cover sheet of construction plans submitted ~or building permit. 26. Size of Plans: The minimum size of construction plans submitted for building permits shall be 24 in. X 36 in. 27. Site Plan: Applications for building hermits shall include competent site plan that identifies property and proposed st uctures with dimensions and elevations as appropriate. Site plan shall also i clude site drainage details. Elevation bench marks shall be called out at all locat ons that are identified as "natural grade" and intended for use to determine the height of the proposed structure. 28. Title 24 Energy Compliance: California Title 24 Energy Compliance forms shall be blue-lined on the construction plans. j 8'/2 X 11 calculations shall be submitted as well. 29. Foundation Inspections: A pad certi icate prepared by a licensed civil engineer or land surveyor shall be submitted to he project building inspector upon foundation inspection. This certificate shall ce ify compliance with the recommendations as specified in the soils report and the b ilding pad elevation and on-site retaining wall locations and elevations are prepare according to approved plans. Horizontal and vertical controls shall be set and ce ified by a licensed surveyor or registered civil engineer for the following items: a. pad elevation b. finish floor elevation (first floor) c. foundation corner locations 30.S~ecial Instructions: When a special inspection is required by C.B.C.
