After notification and public hearing as specified by law on the application
of Mr. Norman C. Garcia on behalf of Rairbo~~ Enterprises for a use permit to
allow a theater on property known as 96 N. San Tomas Aquino Road in a C-2-S
(General Commercial) Zoning District (UP 79-23), as per application filed in
the Office of the Planning Department on July 30, 1979, and after presentation
by the Planning Director, proponents, and opponents, the hearing was closed.
After due consideration of all evidence presented, the Commission did find as
follows:
1. The item has been continued several times in order that the
applicant could provide further information to the Commission.
Z. The additional information requested by the Commission has not
been provided as of the October 16, 1979 meeting.
3. The item should be removed from the agenda.
Based on the above findings, the Planning Commission does hereby deny without
prejudice the requested use permit.
