PC Res 3018RESOLUTION NO. 3018 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, APPROVING A CONDITIONAL USE PERMIT TO ALLOW A COMMERCIAL COMPUTER AND LANGUAGE SCHOOL (CALIFORNIA COLLEGE OF COMMUNICATIONS) WITHIN AN EXISTING OFFICE BUILDING ON PROPERTY LOCATED AT 700 W. HAMILTON AVE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. FILE NO. UP 96-02. After notification and Public Hearing as specified by law to approve a Conditional Use Permit, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 96-02: 1. Commercial schools are permitted in a C-2-S Zoning District subject to the approval of a Use Permit. 2. The proposed school will occupy 2,923 square feet of an existing 56,500 square foot building (5% of the building area). 3. The proposed school is a compatible use within the existing commercial office building and the surrounding neighborhood. 4. The establishment of the proposed school will not entail exterior modifications to the building or site. Based upon the foregoing findings of fact, the Planning Commission concludes that: 1. The proposed project is consistent with the General Plan and the City's zoning ordinance. 2. The proposed project, as conditioned, will aid in the harmonious development of the immediate area; and 3. The establishment, maintenance or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Hamilton Avenue -- California College of Communications Page 2 The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. 1. Approved Project: Approval is granted for a Use Permit allowing for the establishment of a 2,923 square foot private vocational school within an existing commercial office building located at 700 W. Hamilton Avenue. Project shall substantially comply with project plans submitted with the application on January 16, 1996, by Omer Uyuklu. The project shall also substantially comply with the letter dated January 12, 1996, and submitted by the applicant, which identifies the type of classes to be offered, days and hours of operation, floor area to be used and the number of students, instructors and staff at any one given time. o Approval Expiration: The Use Permit approval (UP 96-02) or this project is valid for a period of one year from the Planning Commission approval. All conditions of approval specified herein must be completed within one year from the date of approval or the Use Permit shall be void. Central Fire District: The applicant shall augment existing automatic fire sprinkler system as may be required to maintain proper fire sprinkler coverage. o Signs: A sign application shall be submitted to the Community Development Director in accordance with the provisions for the Sign Ordinance for all signs. No sign shall be permitted until the application is approved and a permit issued. Planning Commission Resolution No. 3018 UP 96-02 - 700 W.
