PC Res 1761RESOLUTION N0. 1761 PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF THE APPLICATION OF MR. SPENCER MUELLER FOR A USE PERMIT TO ALLOW CONSTRUCTION OF A SECOND STORY ADDITION TO A SINGLE-FAMILY RESIDENCE ON PROPERTY KNOWN AS 85 S. THIRD STREET (UP 78-16). After notification and public hearing as specified by law on the application of Mr. Spencer Mueller, UP 78-16, for a use permit and approval of plans to construct a second story addition to a single- family residence located on property known as 85 S. Third Street in a P-D (Planned Development/Medium Density Residential) Zoning District, as per the application filed in the Office of the Planning Director on December 5, 1978, and after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all the evidence presented, the Commission did find as follows: That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. Based on the above findings, the Planning Commission does hereby grant the requested use permit subject to the following conditions: 1. Applicant to sign an agreement, satisfactory to the City Attorney, to provide additional on-site parking if the Planning Commission determines that there is a need for additional parking to serve the development. 2. Applicant to obtain an excavation permit for any work in the public right-of-way. 3. Applicant to obtain all necessary building permits for this addition. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this develop- ment and are not herein specified. USE PERMIT SHALL NOT BECOME EFFECTIVE UNTIL RATIFIED BY THE CITY COUNCIL.
