PLANNING COMMISSION
CITY OF CAMPBELL, CALIFORNIA
After notification and public hearing as specified by law on the
application of Milton and Inge Rosenthal for a use permit and approval
of plans to expand an existing day care center located on property known
as 177 E. Rincon Avenue in a P-D (Planned Development/Medium Density
Residential) Zoning District, as per the application of Milton and Inge
Rosenthal filed in the office of the Planning Director on June 6, 1978
and after presentation by the Planning Director, proponents and opponents,
the hearing was closed.
After due consideration of all the evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort or general welfare of the persons
residing or working in the neighborhood of such use, or be
detrimental or injurious to property and improvements in
the neighborhood or the general welfare of the city.
Based on the above findings, the Planning Commission does hereby
grant the requested use permit subject to the following conditions in
accordance with ordinances of the City of Campbell:
BUILDING DEPARTMENT
A. East wall shall be one hour Table 5-A 30" parapet wall
required at east wall. Section 1709.
B. Roof covering shall be fire retardant. Section 1603(a) and
3203(e).
FIRE DEPARTMENT
C. Capacity limited to 49 day care children.
D. Provide one manual fire alarm pull station and bell.
The applicant is notified that he shall comply with. all applicable
codes or ordinances of the City of Campbell which pertain to this develop-
ment and are not herein specified.
USE PERMIT SHALL NOT BECOME EFFECTIVE UNTIL RATIFIED BY THE CITY
COUNCIL.
