RESOLUTION N0. 1630
PLANNING COMMISSION
CITY OF CAMPBELL, CALIFORNIA
After notification and public hearing as specified by law on the
application of Mr. Gordon C. Fischer for a use permit to allow conversion
of part of an industrial building into a restaurant and bar as provided
in Section 21.32.040 (1) of the Zoning Code, said conversion proposed
for a building being constructed on property known as 1040 Dell Avenue
in a M-1-S Zoning District, as per the application filed in the office of
the Planning Director on June 27, 1977, and after presentation by the
Planning Director, proponents, and opponents, the hearing was closed.
After due consideration of all evidence presented, the Commission
did find as follows:
1. That the establishment, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort or general welfare of the persons
residing or working in the neighborhood of such use, or be
detrimental or injurious to property and improvements in the
neighborhood or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby grant
the requested use permit subject to the following conditions:
1• Applicant to submit landscape plan for approval by the
Planning Director.
2. Applicant to sign an agreement, satisfactory to the City Attorney,
that two of the bays will be used for warehouse purposes only.
3• Elimination of stairway and any second story structure.
4. Conditions of approval of "S" 77-7.
BUILDING DEPARTMENT:
5• Applicant to secure all necessary building, electrical, plumbing,
and heating permits.
FIRE DEPARTMENT:
6. Obtain a permit to operate a place of assembly.
7. Provide an emergency lighting system.
8. Submit plans for hood protection system and fire detection system,
and obtain a permit prior to installation.
