PC Res 1583RESOLUTION N0. 1583 PLANNING COMMISSI0N CITY OF CAMPBELL, CALIFORNIA After notification and public hearing as specified by the law on the application of Dr. Karen R. Leland fora use permit to allow a veterinary clinic for cats to be locat"d on property known as 163 East Hamilton Avenue in a C-1-S (Neighborhood Commercial) Zoning District, as per the application filed in the office of the Planning Department on January 31, 1977, and after presentation by the Planning Director, proponents, and opponents, the hearing was closed. After due consideration of all evidence presented, the Commission did find as follows: 1. That the establishment, maintenance and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such use, or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. based on the above findings, the Planning Commission does hereby grant the requested Use Permit subject to the following conditions: 1. Approval of T.A. 77-1. ' 2. Overnight boarding for treatment purposes to be limited to twenty cats. 3. The entire clinic, including treatment rooms, cages e^ pens shall be maintained within a completely enclosed, soundpr~~~ ~ building constructed of materials, which will insure that no ,~und exceeding sixty-five decibels shall be audible on the exterior of the building. Building to be certified by a noise consultant. Tl~e clinic shall also be provided with air conditioning which is adequate to prevent the necessity .of opening doors and windo4vs for ventilation purposes. 4. The clinic shall be designed and operated in such a manner as to guarantee that no objectionable odors or noises shall be produced outside its walls, and provisions for the off-site disposal of all dead animals and of ail waste materials shall be made in compliance with County health standards. the removal of such waste material and dead animals shall be done so as to guarantee that no obnoxious odor is produced. There shall be no burning or other disposal of dead animals on the premises. 5. Parking shall be provided on the ratio of five spaces per doctor. 6. The proposed operation shall be located no closer than fifty feet to any residentially zoned property. 7. Tf•re normal hours of operation shall be limited to 8:00 a.m. to 6:U0 p.m. However, emergency calls after hours are not prohibited, .8. Pet clinics shall comply with all other State, County, and City Ordinances, or portions thereof, which pertain to the use or zone tivtierein suci~ use is conducted. 9. Applicant to secure site and architectural approvals. 10. Approval of G.P. 76-9. 1-i. The use permit shall expire one year from the date of the approval of the use permit if construction has not started.
