BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL APPROVING
A SITE AND ARCHITECTURAL APPROVAL TO ALLOW A
NEW SINGLE-FAMILY RESIDENCE ON PROPERTY
LOCATED AT 392 WALDO DRIVE IN AN R-l-16 (SINGLE
FAMII,Y RESIDENTIAL ZONING DISTRICT.

After notification and public heating, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the heating was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application S 96-08:
The proposed dwelling is architecturally compatible with the surrounding area and
reflects the policies of the San Tomas Area Neighborhood Plan by incorporation of
various architectural elements, including wood siding and trim, a prominent porch and
a low (4 in 12) sloped roof pitch..
2. The subject property is a legal non-conforming lot and can be developed in accordance
with the R-1-6 development standards of the San Tomas Area Neighborhood Plan.
3. The proposed project meets the standards of the R-1-6 zone in the San Tomas Area
Neighborhood Plan.
4. The retention of mature existing trees on the site contributes to the quality of
development and enhances the neighborhood.
5. The planting of three new trees to replace three being removed will assure the
continuity of the San Tomas Area tree canopy.
Based upon the foregoing findings of fact, the Planning Commission concludes that:
1. The proposed project is consistent with the intent of the General Plan and the zoning
standards.
2. The proposed project will aid in the harmonious development of the immediate area.

Further, the applicants are notified as part of this application that they are required to
comply with all applicable Codes and Ordinances of the City of Campbell and the State of
California which pertain to this application and are not herein specified. And, that this
approval is granted subject to the following Conditions of Approval.
Approved Project: Approval is granted for a Site and Architectural Review Permit
allowing construction of a new two-story, single family residence on property located
at 392 Waldo Road. Project approval shall substantially comply with the plans
prepared by Moe Khadem, dated June1996, except as modified by the Conditions of
Approval herein:
The applicant shall submit a revised front elevation modifying the roof vent to fit
with the shape of the roof gable and a heavy porch colunm which has greater
architectural detail/refinement.
Tree Retention/Landscaping: The applicant shall submit a landscaping plan indicating
the type and size of the three trees to replace the three to be removed. The plan shah
include a tree protection plan and details to protect and keep healthy the front walnut
and larger scrub oak trees during construction. The plan shall be submitted to and
approved by the Community Development Department prior to any grading and
issuance of building permits.
Screening of Utility_ Facilities: All above-ground utility equipment, including air
conditioning equipment, shall be screened from public view to the satisfaction of the
Community Development Director.
4. Park lm~nact Fee. The applicant shall pay a park impact fee of $10,990 for a new
single-family residence prior to receipt of a certificate of occupancy.

Underground Utilities: All electrical, telephone, cable television and other utility
facilities shall be installed underground in accordance with the provisions of Chapter
20.36.150 of the Municipal Code and as required by the City Engineer, prior to receipt
of a Certificate of Occupancy.
6. Water Service: A water distribution service shall be installed in conformance with the
requirements of the San Jose Water Company.
Driveway Standards: An asphalt/concrete driveway shall be installed which conforms
to the standards of the San Tomas Area Neighborhood Plan to the approval of the City
Engineer.

Encroachment Permit: Permits and approvals for work within the public right-of-way
shall be obtained prior to commencement of any work therein. The permits and
approvals of this work shall be coordinated with the City of Campbell.
Utility Construction Coordination in Public Right-of-Way: A Utility Coordination
Plan and Schedule shall be submitted for approval to the City Engineer for installation
of electrical, telephone, cable television, sewer, water, storm drain improvements and
any other utilities to the house in order to minimize damage to City streets and related
facilities. This plan must be submitted and receive approval prior to the issuance of
any building permits.
10. San Tomas Area Plan: All work shall comply with the San Tomas Area Neighborhood
Plan standards, including all public improvements.
11. Sanitary_ Sewer Service: A sanitary sewerage system shall be installed in conformance
with the requirements of the West Valley Sanitation Service District.
12. Development Approval Expiration: The Site and Architectural approval for this
project is valid for a period of one year t~om the date of the Planning Commission
approval.
