PC Res 3040RESOLUTION NO. 3040 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUSLY-APPROVED SITE & ARCHITECTURAL APPROVAL (S 95-14) TO ALLOW THE CONSTRUCTION OF A 6,000 SQUARE FOOT INDUSTRIAL BUILDING ON PROPERTY LOCATED AT 555 MeGLINCEY AVENUE IN AN M-1-S (LIGHT INDUSTRIAL) ZONING DISTRICT. APPLICATION OF MR. TJ MARRONE. M 96-11 (S 95-14) After notification and public heating, as specified by law, and at~er presentation by the Commttnity Development Director, proponents and opponents, the heating was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application M 96-11: 1. The proposed development provides approximately 22% of net site area with landscaping which substantially enhances the development. 2. The project provides 16 parking spaces and complies with the parking standards for warehousing and office uses. 3. The use of decorative exterior treatment and quality building materials contributes to the quality of the proposed development. Based upon the foregoing findings of fact, the Planning Commission concludes that: 1. The proposed project, subject to the conditions imposed, will be consistent with the General Plan; and 2. The proposed project, subject to the required conditions, will aid in the harmonious development of the immediate area. Further, the applicants are notified as part of this application that they are required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this application and are not herein specified. And, that this approval is granted subject to the following Conditions of Approval. Planning Commission Resolution No. 3040 M 96-11 - 555 McGlincey Lane Page 2 Project Approval: Approval for this project allows a 5,947 square foot, single-story, light industrial building at 555 McGlincey Lane. The building and land improvements shall substantially comply with plans prepared by Britt and Rowe, dated July 15, 1996. 2. Approved Plans: Development Schedule: The approval is valid for a period of one year following the Planning Commission approval. Construction must begin within one year t~om the date of approval or the permit shall become void. Parking & Driveways: All parking and driveways shall be developed in accordance with Chapter 21.50 of the Campbell Municipal Code including parking modifications as approved by the City. Handicapped parking space adjacent to rear paved outdoor storage area shall not be blocked or used as access to paved outdoor storage area. Co Building Color: Color samples shall be submitted to the Community Development Department for review and approval prior to issuance of building permits. Trellis Element: Applicant to submit revised elevations indicating a trellis feature on the wall adjacent to the office area on the east elevation of the building prior to the issuance of building permits. The trellis may be attached to the wall and shall be located at the height of the office awnings. 3. Landscaping: ho Site Landscaping Plan: Applicant shall provide four sets of landscape and irrigation plans indicating type and size of plant materials, irrigation system and planting details to be submitted to the Planning Department and approved by the Community Development Director prior to issuance of building permits. Landscaping plan shall substantially conform to the conceptual landscape plan dated November 13, 1995, previously approve for S 95-14. The landscape plan shall include trees along the perimeter of the property. Landscape planter areas shall include a combination of ground cover and shrubs in addition to trees. All trees planted shall be a minimum size of 24" box. B° Street Trees: Street trees shall be required in the public right-of-way along the MeGlincey Lane ~ontage in accordance with City Street Tree Standards and Specifications. Landscape Standards: All landscaping shall comply with the City's Water Efficient Landscape Standards (WELS). 4. Site Construction: Construction and Equipment: Applicant shah utilize construction equipment which adequately levels the noise in accordance with Section 18.02.030 of the City of Campbell Municipal Code. Construction activity and construction equipment shall comply with all air quality emission policies as determined by the Bay Area Air Quality Management District and the Building Official for the City of Campbell. Bo Construction Hours: Hours of construction shall be limited to 8 a.m to 5 p.m, Monday through Friday, and 9 a.m to 4 p.n~, Saturdays. No construction is permitted on Sundays or Holidays. C. Construction Site: The construction site shall be sprinklered with water, as necessary, but not less than twice per day, in areas of new construction or grading where dirt is exposed, to control dust. 2. Haul trucks and material stockpiles shall be covered. The construction area and surrounding areas shall be swept as necessary, but not less than once daily. All areas shall be adequately fenced for safety, per the Building Official, during construction. Handicapped Access: All new and remodeled buildings shall provide handicapped access in accordance with the Uniform Building Code (UBC) and the Uniform Federal Accessibility Standards (UFAS) and the Federal American's With Disabilities Act (AOA). Mechanical Equipment: All roof-mounted and ground-level mechanical equipment on new or remodel structures on site which are visible from the public right-of-way shall be screened with similar building materials subject to the approval of the Community Development Director Planning Commission Resolution No. 3040 M 96-11 - 555 McGlincey Lane Page 4 Uniform Building Code Requirements: One (1) hour fire resistive construction within five (5) feet of the property line, if F-2 occupancy. One (1) hour fire resistive construction within 20 feet of the property line, ifF- 1 occupancy. 8. Building Code Requirements: No openings permitted less than five (5) feet at right angles to the property line. Fire Code Requirements: The required fire flow is 2,000 GPM at 20 psi residual pressure. If the required fire flow is not available from area fire hydrants, provide an approved automatic fire sprinkler system throughout all portions of the building. A. Provide an approved type fire department key box and appropriate keys. B. Provide approved type monitoring for all fire sprinkler alarm devices. 10. Dedication to the City: Prior to issuance of any building permits for the site, the applicant shall dedicate additional right-of-way along the McGlincey frontage to accommodate the required installation of Standard Street Improvements. Applicants shall prepare all documents necessary to record dedication and submit to the City for review, acceptance and recording. Future Dedication: Applicant shall also enter into an agreement with the City for future dedication of right-of-way, relinqui,qhment of easements and/or acceptance of excess right-of-way to accommodate the alignment of the future street along the easterly side of the property. 11. Storm Drain Area Fee: Prior to issuance of any building permits for the site, the applicant shall pay the required Storm Drain Area Fee of $2,500 per acre. 12. Grading and Drainage Plan: Prior to issuance of any building permits for the site, the applicant shall conduct hydrology studies as necessary, prepare grading and drainage plans, pay fees required to obtain necessary grading permits and install all necessary drainage facilities in accordance with the approved grading and drainage plans. Drainage plans shall include existing conditions on adjacent properties. Planning Commission Resolution No. 3040 M 96-11 - 555 McGlincey Lane Page 5 13. Standard Street lm,nrovements: Prior to issuance of any building permits for the site, the applicant shall prepare plans, pay fees, post securities and provide insurance as required to obtain an encroachment permit to construct public street improvements as required by the City Engineer. Public street improvement plan shall be prepared by a registered CMl Engineer, licensed in the State of California, and shall include the following: A. McGlincey Frontage 1. Remove existing driveway cut on McGlincey and install City Standard curb, gutter and 5' marginal sidewalk; 2. Install new City Standard sidewalk along entire McGlincey frontage; 3. Install City Standard street trees behind back of walk; and 4. Provide and install new City Standard street light. 14. Future Street Frontage (along easterly side of property): Applicant shall enter into an agreement with the City for the design and construction of future street improvements. Future street improvements shall include storm drainage facilities, monumentation, street lighting, standard curb, gutter, sidewalk, handicap ramps, street trees, street pavement, pavement signing and striping, relocation of utilities. Agreement shall indicate that applicant is responsible for design and construction of future improvements, for connection of property to future storm drainage facilities and relocated utilities and for any on-site improvements that may be required due to the future street improvements. This condition may be satisfied by an Agreement between the City and the Redevelopment Agency for construction of furore street irn~nrovements. 15. Completion of Public Street Improvements: Prior to issuance of occupancy for the site, all public street improvements for the McGlincey frontage as required by the encroachment permit must be completed and accepted by the City Engineer and the applicant must provide the one-year maintenance security. 16. Underground Utilities: All new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall provide evidence from all utility companies that the application as proposed can be served. Applicant shall comply with all plan submittals, permitting and fee requirements of the serving utility company. Applicant shall submit a Utility Coordination Plan and Schedule for approval by the City Engineer for installation of all utilities. The plan shall minimize the damage to all public facilities. Planning Commission Resolution No. 3040 M 96-11 - 555 McGlincey Lane Page 6 17. Title Report: Provide a current Preliminary Title Report. 18. Reciprocal Ingress and Egress Easements: Provide evidence that the reciprocal ingress and egress easements exist and are adequate for access to and from the parcel. 19. Storm Water Management: Comply with California Storm Water Best Management Practices Handbook, prepared by Storm Water Quality Task Force, Santa Clara Valley Water District. 20. Garbage Collection; Trash containers of a size and quantity necessary to serve new or modified building areas shall be located in areas approved by the Fire Department. Unless otherwise noted, enclosures shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers.
