A RESOLUTION OF THE CITY OF CAMPBELL CITY COUNCIL AUTHORIZING THE
COMMUNITY DEVELOPMET DHtECTOR TO ENTER INTO AN AGREEMENT WITH SRM
DEVELOPMENT AUTHORIZING THE DEFFERAL OF CERTAIN PERMIT FEES FOR THE
MERRILL GARDENS SENIOR HOUSING PROJECT AT 2041-2127 WINCHESTER
BOULEVARD
WHEREAS, the Campbell City Council (the "Council") granted zoning approvals to SRM
Development (the "Developer") for the construction of 127 unit senior housing project including
approximately 17,000 square feet of commercial space (the "Project") on November 20, 2007, and
subsequently approved a time extension on June 23, 2009.
WHEREAS, due to continued poor economic conditions, SRM has been unable to move forward
with building permits and secure construction financing to build the project; and
WHEREAS, the significant fees required to secure a building permit creates an obstacle for the
Developer in moving ahead with the Project and the Council desires to assist the Developer in minimizing
some of the economic barriers.
NOW, THEREFORE, BE IT RESOLVED, that the City of Campbell City Council authorizes
the Community Development Director to enter into an agreement with SRM Developer allowing the
developer to defer payment of all but $400,000 of the required fees to be paid upon issuance of a building
permit until June 30, 2011 or the commencement of construction of the Project, whichever comes first
conditioned upon SRM securing a building permit prior to January 3, 2011.
