A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE DESTRUCTION OF CERTAIN CITY RECORDS ON A REGULARLY
SCHEDULED BASIS
WHEREAS, the digital storage requirements associated with Digital Ally and VieVu video
imaging systems are significantly higher than other City systems; and
WHEREAS, Government Code Section 34090.6 et seq. authorizes City Department Heads to
destroy certain records, documents, instruments, books or paper after the same are no longer
required and/or have been digitally imaged, stored on CD/DVD medium and secured off-site in
accordance with State law and the City of Campbell's Records Retention Schedule and
Document Imaging Administrative Policy with the approval of the legislative body by resolution;
and
WHEREAS, staff will maintain a list of all files to be destroyed under this authorization and
provide this list to the City Attorney prior to their destruction; and
WHEREAS, the City Attorney has reviewed this resolution, and is granting his approval for the
destruction of the Digital Ally and VieVu digital files that are eligible for destruction pursuant to
Government Code 34090.6 and the City of Campbell's Records Retention Schedule; and
WHEREAS, the City Council proposes to grant such approval for the destruction of the Digital
Ally and VieVu digital files that are eligible for destruction pursuant to Government Code
34090.6 and the City of Campbell's Records Retention Schedule.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does
hereby authorize the Chief of Police to destroy Digital Ally and VieVu video files which are
eligible for destruction per Government Code 34090.6 and the City of Campbell's Records
Retention Schedule each month on a routine basis.
BE IT FURTHER RESOLVED that the City Council's authorization for destruction of the Digital
Ally and VieVu video files by the Chief of Police shall immediately expire if a change is made to
an applicable Government Code, the City of Campbell's Record Retention Schedule or
Document Imaging Administrative Policy.
