PC Res 3046RESOLUTION NO. 3046 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL GRANTING A SITE AND ARCHITECTURAL APPROVAL TO ALLOW A MOVE-ON HOME TO BE LOCATED AT 53 SHELLEY AVENUE IN AN R-l-6 (SINGLE FAMILY RESIDENTIAL ZONING DISTRICT. APPLICATION OF MS. EMII.Y CHEN. FILE NO. S 96-10. ARer notification and public heating, as specified by law, and at~er presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application S 96-10 The proposed project is consistent with the R-l-6 (Single-Family Residential - 6,000 square foot minimum lot size) Zoning District and development standards in terms of setbacks, lot coverage, parking, open space, lot size and building height. 2. The proposed project is architecturally compatible with the surrounding neighborhood and will integrate well with the neighborhood. The development of the property will result in a density of 5.41 dwelling units per gross acre and is consistent with the General Plan density of less than 6 dwelling units per gross acre for this area. Based upon the foregoing findings of fact, the Planning Commission timber finds and concludes that: 1. The proposed project is consistent with the General Plan and the City's Zoning Ordinance. 2. The proposed project, as conditioned, will aid in the harmonious development of the immediate area. Further, the applicants are notified as part of this application that they are required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this application and are not herein specified. And, that this approval is granted subject to the following Conditions of Approval. Planning Commission Resolution No. 3046 S 96-10 - Ms. Emily Chert- 53 Shelley Avenue Page 2 Approved Project: Approval is granted for a Site and Architectural Review permit allowing a move- on single-thmily residence and garage on property located at 53 Shelley Avenue. Project plans shall substantially comply with the project plans prepared by Emily Chen, dated July 1, 1996, except as modified by the Conditions of Approval herein. Roof Plan and Revised Elevations: A. The applicant shall submit a roof plan of the proposed residence to be reviewed and approved by the Community Development Director prior to issuance of any building permits. B. The applicant shall submit revised elevations, depicting in further detail the batten board exterior, the modification of the front entrance and the detailing of the windows, to be reviewed and approved by the Community Development Director, prior to issuance of any building permits. Site and Architectural Approval Expiration The Site and Architectural approval (S 96-10) for this project is valid for a period of one year from the Planning Commission approval. All Conditions of Approval specified herein must be completed within one year from the date of approval or the permit shall be void. Btfilding Division Requirements: A. Applicant shall comply with B. C. D. all Building Code requirements and obtain necessary permits as determined by the Building Division. Applicant shall be required to obtain a building permit and final inspection of the foundation prior to issuance of a house-moving permit. All structures shall be set in place within seven (7) days of moving the structures onto the project site. The applicant shall construct protective fencing around the project site and structures during all construction related to the moving and placement of the residence and garage on the project site (Section 3303.7.3 of the UBC). Relocation Permit: Prior to issuance of a permit to relocated the residence and garage, the applicant shall be required to obtain approval from the Police Department and the Building Division. Parcel Map: Applicant shah comply and complete aH Conditions of Approval associated with Tentative Parcel Map application (PM 95-05) prior to issuance of building permits allowing the structure to be moved on the future parcel. Park Impact Fee: The applicant shah pay a park impact fee of $10,990 for the single-family residence prior to issuance ora certificate of building occupancy. Credit shall be given for fees previously paid. Underground Utilities: Underground utilities to be provided Campbell Municipal Code. as required by Section 20.36.150 of the Property_ Maintenance: The property is to be maintained free of any combustible trash, debris and weeds until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut or be demolished or removed from the property (Section 11.201 and 11.414, 1985 Ed. Uniform Fire Code). Parking and Driveways: All parking and driveway areas shall be developed in compliance with the standards in Chapter 21.50 of the Campbell Municipal Code. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Catnpbell Municipal Code. Tree Protection Plan: The applicant shall comply with the City's Water Efficient Landscaping Standards and submit a tree protection plan to be reviewed and approved by the Community Development Director prior to issuance of a building permit.
