PC Res 3049RESOLUTION NO. 3049 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO ALLOW CELLULAR ANTENNAS AND GROUND-MOUNTED EQUIPMENT ON PROPERTY LOCATED AT 125 E. SUNNYOAKS AVENUE IN AN M-1-S (LIGHT INDUSTRIAL) ZONING DISTRICT. APPLICATION OF MS. PATTY MEJIA, ON BEHALF OF SPRINT SPECTRUM. UP 96-10. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application UP 96-10: Public service facilities are permitted in the M-1-S Zoning District subject to the approval of a conditional use permit. The project is compatible with the existing building and site, subject to the conditions of approval. The placement of the antennas on the roof, with the installation of on-site and off- site landscaping to screen the antennas from public view complies with the intent and purposes of the Site and Architectural Review Ordinance. Additional landscaping including 24" box and 15 gallon Redwood trees along the perimeter of the property will upgrade the site and provide screening of the antennas from the public view. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project is consistent with the General Plan and the local zoning ordinance, and; 2. The proposed project as conditioned will aid in the harmonious development of the immediate area; The establishment, maintenance or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Sunnyoaks Avenue - Sprint Spectrum Page 2 The proposed site is of adequate shape and size to accommodate the yards, walls, fences, screening, landscaping and other development features required in order to integrate said use with uses in the surrounding area. Further, the applicants are notified as part of this application that they are required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this application and are not herein specified. And, that this approval is granted subject to the following Conditions of Approval. Approved Project: Approval is granted for a Use Permit allowing for the installation of a cellular antenna facility on property located at 125 E. Sunnyoaks Avenue. Project approval shall substantially comply with project plans prepared by Ehrlich Rominger stamp dated 10/4/96 except as modified herein in the Conditions of Approval. Project Design: The facility shall consist of three, two panel attached antennas on three poles mounted on the roof and attached to the equipment screen. The ground mounted equipment shall be near the landscape border near the westerly property line, and be screened with landscaping if visible from public view. Final plans shall be submitted for review and approval by the Community Development Director prior to issuance of building permits. 3. Permits: Applicant shall obtain any permits deemed necessary by the Building Official or the Uniform Building Code. Development Approval Expiration: The Use Permit approval (UP 96-10) for this project is valid for a period of one year from the Planning Commission approval. All conditions of approval specified herein must be completed within one year from the date of approval or the Use permit shall be void. Landscaping: Applicant shall submit four (4) sets of a revised landscaping plan indicating 24" box redwood trees along the County right-of-way adjacent to the San Tomas Expressway off-ramp, and a combination of 24" box and 15 gallon Redwood trees around the perimeter of the property, and landscaping for the area surrounding the ground mounted equipment enclosure if visible from the public view. Planting details and the irrigation system shall be submitted to the Community Development Department for review and approval prior to the issuance of building permits. Planting shall be done in accordance with Western Chapter ISA pruning standards and be performed at minimum by a Western Chapter ISA Tree Worker, under the full time supervision of a Certified or Consulting Arborist. Sunnyoaks Avenue - Sprint Spectrum Page 3 Off-Site Landscaping: Plans for landscaping in the County right-of-way shall be submitted to the Campbell Planning Division for review and approval prior to submittal to the Santa Clara County Land Development and Permits Department. All necessary approvals and permits for landscaping on land located in the County right- of-way must be obtained at the expense of the applicant from the Santa County Land Development and Permits Division. The submittal of the off-site landscape plans shall be coordinated by the Campbell Community Development Department. Review of Approval: This approval is effective for five years. The owner or owner's representative will revisit the Use Permit application every five years to determine that the equipment is consistent with current technology of new installations at that time and is visually less obtrusive as compared with what is in place at this time.
