BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL REGARDING THE LEVEL OF CAFETERIA PLAN
BENEFITS PROVIDED TO COUNCILMEMBERS
WHEREAS, Government Code 53200 et. seq. specifically authorizes providing health
benefits to councilmembers, and states, "Notwithstanding any statutory limitation upon
compensation... any member of a legislative body may participate in any plan of health
and welfare benefits permitted by this article;" and
WHEREAS, Government Code Section 36516 (d) provides, "Any amounts paid by a city
for retirement, health and welfare, and federal social security benefits shall not be
included for purposes of determining salary under this section, provided that the same
benefits are available and paid by the city for its employees; "and
WHEREAS, in order to document compliance with Section 36516 (d), it is
recommended that Council adopt a resolution clearly linking their benefits to those of
employees; and
WHEREAS, the level of health benefits and life insurance for Campbell employees is
part of the collective bargaining process and varies between the employee groups; and
WHEREAS, Council's role is most analogous to that of management employees, it is
recommended that the City Council be eligible for the same amount of health care
benefits provided to classified management employees.
NOW, THEREFORE, BE IT RESOLVED that the level of health and life insurance
benefits provided to councilmembers be established at the same monthly benefit
amount provided classified management employees, with no "rebate" of unused
benefits, to be effective with all future Council enrollments and the next annual
reenrollment of current members.
