A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING REQUEST TO REALLOCATE HIGHWAY SAFETY IMPROVEMENT
PROGRAM (HSIP) FUNDS FROM THE CAMPBELL AVENUE/LEIGH AVENUE
SIGNALIZATION PROJECT TO THE LEIGH AVENUE/DRY CREEK ROAD
INTERSECTION IMPROVEMENT PROJECT
WHEREAS, the City of Campbell was awarded a Highway Safety Improvement
Program (HSIP) grant for $324,000 for the design and construction of the Campbell
Avenue/Leigh Avenue Signalization Project; and
WHEREAS, on August 25, 2010, approximately 50 residents from Campbell and San
Jose appeared at a community meeting to oppose this project; and
WHEREAS, San Jose Department of Transportation (DOT) does not consider the
Campbell/Leigh intersection a priority and, given the expressed community concerns,
does not see a compelling need to continue with the project; and
WHEREAS, the Cambrian School District has eliminated from its budget school bus
transportation to Bagby Elementary School; and
WHEREAS, an increased number of schoolchildren from the Union Avenue/Apricot
Avenue area in Campbell will be walking along Leigh Avenue to Bagby Elementary
School in San Jose; and
WHEREAS, the Leigh Avenue/Dry Creek Road Intersection Improvement Project
would construct improvements to the Leigh Avenue/Dry Creek Road intersection to
meet Americans with Disabilities Act (ADA) standards and accommodate the increased
number of schoolchildren that use this intersection to walk to school; and
WHEREAS, the northwest corner of the Leigh Avenue/Dry Creek Road intersection is
in Campbell and the rest of the intersection is in San Jose; and
WHEREAS, the preliminary engineer's estimate to design and construct the Leigh
Avenue/Dry Creek Road Intersection Improvement Project is $360,000; and
WHEREAS, Caltrans has expressed reluctance to transfer the HSIP grant funds from
the Campbell/Leigh Signalization Project to any other project that does not address
safety concerns at the Campbell/Leigh intersection; and
WHEREAS, staff recommends approaching Caltrans with a request to transfer HSIP
grant funds for the Campbell/Leigh Signalization Project to the Leigh Avenue/Dry Creek
Road Intersection Improvement Project; and
WHEREAS, the Leigh Avenue/Dry Creek Road Intersection Improvement Project is
located close to the Campbell/Leigh intersection and has support from the public, City of
San Jose, Cambrian School District, and Bagby Elementary School; and
WHEREAS, securing Caltrans' approval of a transfer of HSIP funds to the Leigh
Avenue/Dry Creek Road Intersection Improvement Project would eliminate the need to
return the funds already reimbursed to the City for the Campbell/Leigh project; and
WHEREAS, forfeiting the HSIP grant would mean relinquishing the grant and returning
any funds for which the City of Campbell has already been reimbursed for the
Campbell/Leigh project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that the Public Works Director is hereby authorized to approach Caltrans with a request
to transfer Highway Safety Improvement Program (HSIP) grant funds from the Campbell
Avenue/Leigh Avenue Signalization Project to the Leigh Avenue/Dry Creek Road
Intersection Improvement Project with the Harriet Avenue/McCoy Avenue Signalization
Project as an alternative.
BE IT FURTHER RESOLVED that the City Council authorizes the Public Works
Director to forfeit the HSIP grant and return any reimbursed funds for the
Campbell/Leigh project should Caltrans refuse to grant a fund transfer.
