BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL DENYING A MODIFICATION
TO A PREVIOUSLY-APPROVED CONDITIONAL USE PERMIT
(UP 91-02) TO ALLOW 24-HOUR OPERATING HOURS FOR A
SERVICE STATION (ROTTEN ROBBIE'S) LOCATED AT 370
E. HAMILTON AVENUE IN A C-1-S (NEIGHBORI-tOOD
COMMERCIAL) ZONING DISTRICT. APPLICATION OF
COAST OIL COMPANY. FILE NO. M 96-16 (UP 91-02).
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application M 96-16 (UP 91-02):
1. The gasoline station is in close proximity to residential homes.
The existing station already interferes with residential use due to traffic and
loitering and related noise and trash.

The extension of hours would allow an increase of intrusion into the residential
area.
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:
The establishment, maintenance or operation of the use applied for will be
detrimental to the health, safety, peace, morals, comfort, or general welfare of
persons residing or working in the neighborhood of such proposed use, or be
detrimental or injurious to property and improvements in the neighborhood or to the
general welfare of the City.
The proposed site is not adequate in size and shape to accommodate the yards,
walls, fences, parking and loading facilities, landscaping and other development
features required in order to integrate said use with uses in the surrounding area.
The proposed side is not adequately served by streets of sufficient capacity to carry
the kind and quantity of traffic such use would generate.
4. The proposed use is not compatible with the uses in the area.
