PC Res 2949RESOLUTION NO. 2949 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A PLANNED DEVELOPMENT PERMIT TO ALLOW CONSTRUCTION OF A 5,000 SQUARE FOOT RETAIL AND AUTOMOTIVE BUILDING ON PROPERTY LOCATED AT 535 W. HAMILTON AVENUE, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. FILE NO. PD 94-02. After notification and Public Hearing, as specified by law, on the application of Mr. Ken Redelsperger, for approval of a Planned Development Permit to allow the construction of a 5,000 square foot retail and automotive building on property located at 535 W. Hamilton Avenue in a PD (Planned Development) Zoning District, as per the application filed in the Planning Department on September 15, 1994; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. PD 94-02: The proposal is consistent with the General Plan and Zoning District which permits commercial land uses. 0 The proposal greatly exceeds the landscape requirement of commercial zoning districts by providing landscaping of 34% of the site area. ge The proposed parking adequately addresses the parking needs of the proposed uses with the concept of standard parking and stacking spaces within and in front of the auto service building. o The proposed project is of an appropriate scale and design and is compatible with the existing commercial and residential development in the area. The presented site plan is adequately sized and will be so improved to integrate the proposed uses into the neighborhood and surrounding commercial development. The conditions of approval requiring the extension of the trellis element along Millich Drive will screen the service bays and better integrate the development with the surrounding residential and commercial uses. Hamilton Avenue Adopted on January 24, 1995 Page 2 Based upon the foregoing findings of fact, the Planning Commission concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. e The proposed site is adequately served by streets of suffident capacity to carry the kind and quantity of traffic such use would generate. ge The proposed development and uses clearly would result in a more desirable environment and use of land than would be possible under any other zoning classification. e The proposed project is consistent with the General Plan and Zoning of the site and will aid in the harmonious development of the immediate area. Further the applicants are notified as part of this application that they are required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this application and are not herein specified and that this approval is granted subject to the following Conditions of Approval: Approved Project: This approval is for a 5,000 square foot retail and automotive building located on property known as 535 W. Hamilton Avenue. Development shall substantially comply to project materials listed below, except as may be modified by the Conditions contained herein. Approval is granted to operate Snappy Lube, oil change operation per the following conditions of approval. Plans: Project drawings prepared by Integrated Architecture, dated December 12, 1994. Hamilton Avenue Adopted on January 24, 1995 Page 3 o Operational Use: The operation shall comply with the written operational statement contained in this report and shall at no time permit or provide automotive related repair including but not limited to tire services, brake repair, engine repair, body or transmission repair. The approved use for the auto service area allows an oil change use only. Ce Revised Site Plan: Applicant to submit a revised site plan indicating a 20 foot wide, one way in driveway on Hamilton Avenue and elimination of the parking space adjacent to this driveway entrance and replacement of this area with additional landscaping. Trellis Extension: Submit revised elevations indicating extension of the trellis feature along Millich Drive to screen the service bay areas. Eo Building Colors: Color board on file in the Community Development Department. Limited Hours: Operational hours of retail businesses are limited to the hours between 6 a.m. and 11 p.m., unless otherwise approved by the Planning Commission. Auto Service Hours of Operation: Per the applicant's indicated hours of operation, the Snappy Lube auto service use will be limited to the following hours: Monday through Friday 8:00 am to 6:00 pm Saturday 8:00 am to 5:00 pm Sunday 9:00 am to 4:00 pm Landscaping: Four (4) sets of landscape and irrigation plans indicating type and size of plant materials, irrigation system and planting details to be submitted to the Planning Department and approved by the Community Development Director prior to issuance of building permits. Hamilton Avenue Adopted on January 24, 1995 Page 4 e o e Elimination of parking space adjacent to the Hamilton Avenue driveway entrance and replacement of this area with additional landscaping. Performance Bond: Applicant is to either (1) post a faithful performance bond in the amount of $15,000 to ensure landscaping, fencing and striping of parking areas within 3 months of completion of construction. Bond to be filed with the Planning Department prior to application for a building permit. Outside Seating: Applicant to submit a plan indicating specific seating and table arrangements. Seating shall be permitted subject to parking available to support the use and shall be approved by the Community Development Director prior to installation. Utility Boxes: Applicant to submit a plan to the Planning Department, prior to installation of PG&E utility (transformer) boxes, indicating the location of the boxes and screening (if boxes are above ground) for approval of the Planning Director. Future Shared Driveways; The applicant/property owner shall record an covenant and deed restriction running with the land, which obligates existing and future property owners to enter into a reciprocal ingress/egress easement with the adjacent property to the west to implement a shared curb cut and driveway aisle along the common property line. The cost for implementing said driveway shall be borne by the property owners at no cost to the City. Said easements and driveway improvements shall be implemented at such time in the future as the adjacent property owner agrees to the driveway and easement. The covenant shall be subject to review and approval by the City Attorney. Lighting Plan: Lighting plan shall be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. Signs: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign shall be installed until application is approved and a permit issued by the Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). Project signing as presented on plans is not approved. 11. Equipment Screening: All mechanical equipment on roofs and all utility meters to be screened as approved by the Planning Director. 12. Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. PUBLIC WORKS 13. Grading and Drainage Plan: The applicant shall submit three (3) copies of a grading and drainage plan for review by the City Engineer. The storm drainage system which serves this site must connect to a public underground storm drainage system. 14. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. 15. Utility Connections: Plans submitted to the Building Division for plan check indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. 16. Traffic Counts: The applicant shall prepare traffic counts for the Hamilton Avenue and Llewellyn Drive intersection or pay a fee not to exceed $300.00 to the City of Campbell Public Works Department to conduct traffic counts. 17. Encroachment Permit: The applicant shall submit plans, pay fees, post surety and obtain an encroachment permit for all work in the public right-of-way. Dedication: Applicant shall dedicate public, street right of way for Boulevard treatment on Hamilton Avenue as directed by the City Engineer. 19. Fire Sprinklers: Structure requires the installation of an automatic fire sprinkler system throughout all portions of the building. This system shall conform to NFPA 13, 1989 edition. FIRE DEPARTMENT 20. Hazardous Materials Plan: Applicant shall submit a plans to building permit and hazardous material storage to Central Fire for review. 21. Property Maintenance: The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size spedfied by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. BUILDING DEPARTMENT 24. Building Code: The plans shall be subject to review and approval by the Building Official and shall conform to all codes and policies in effect at the time of building plan submittal. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped.
