PC Res 2952RESOLUTION NO. 2952 BEING A RESOLUTION OF THE PLANNING COMMISSION, CITY OF CAMPBELL, RECOMMENDING APPROVAL OF A TI~TATIVE SUBDIVISION MAP, LANDS OF TED BORNS, ON PROPERTY LOCATED AT 80 DOT AVENUE IN PD (PLANNED DEVELOPMENT) ZONING DISTRICT. FILE NO.; TS 94-01 After notification and public hearing as specified by law on the application for approval of a Tentative Subdivision Map as referenced in the above heading; as per the application filed in the Planning Department on March 29, 1994; and, after presentation by the Community Development Director, proponents and opponents, the hearing was dosed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. TS 94-01: The proposed density of 13.8 units per acre is consistent with the Medium-Density Residential (14-20 units per gross acre) designation shown on the Land Use Element of the General Plan. e The proposed Tentative Subdivision Map is consistent with the Planned Development Permit (PD 90-06) approved for this property. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that, subject to the imposed conditions: 1. The proposed subdivision is consistent with the General Plan. The proposed subdivision improves the balance between the housing needs of the region and the public service needs of its residents and available fiscal and environmental resources. e The design of the subdivision provides, to the extent feasible, for future passive or natural heating or cooling opportunities. Based upon the above findings, the Planning Commission does hereby recommend approval of this map to the City Council, subject to the Conditions of Approval attached hereto, as Exhibit A. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified. NO. TS 94-01 SITE ADDRESS: 80 DOT AVENUE APPLICANT: MR. TED BORNS P. C. MEETING: FEBRUARY 14, 1995 The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California. Tentative Map: This Tentative Map approval is valid for two (2) years. A final map must be recorded concurrently with the issuance of building permits within that two (2) year period. Approval of the final plans and the conditions necessary for said approval are not necessarily limited to the approved tentative map conditions listed herein. Common Area/Public Utility_ Easement: The specified common area shall be designated as a public utility easement and identified on final map. All utility easements shall be provided as shown on the approved tentative map on file to meet the requirements of the utility companies and of the Director of Public Works. Monuments: Permanent monuments shall be furnished and installed by the subdivider as required by the City of Campbell and identified on the final map. Common Area Improvements: If the common area improvements are not in place prior to the filing of the final map, the applicant must place adequate security for said improvements with the City of Campbell as determined by the Community Development Director. Improvement Security: Applicant shall enter into standard subdivision agreement with City and provide improvement security as determined by the Public Works Department. Covenant Conditions and Restrictions: Prior to the approval of the final map, Covenant Conditions and Restrictions (CC&Rs), containing the provisions set forth in Section 20.16.035(G-H) of the Subdivision Ordinance, shall be filed with the Community Develop.ment Director. Sewers: Installation of a sanitary sewerage system to serve all lots within the subdivision in conformance with the proposed plans of the West Valley Sanitation District. Sanitary sewerage service to be provided by Water Service: Installation of a water distribution system to serve all lots within the subdivision in conformance with the plans of the San Jose Water Works. Water service to be provided by said water company. Fire hydrants and appurtenances shall be provided and installed at the locations spedfled by the Fire Chief, Central Fire District. Subdivision Map Act: Compliance with the provisions of Title 20, Subdivisions of the Campbell Munidpal Code. Storm Drain Fee: Subdivider to pay Storm Drainage Area Fee of $603 (0.2927Ac. X 2.060 = $603). Title Report: Subdivider to furnish copy of Preliminary Title Report. Street improvements: Subdivider shall execute an agreement, install street improvements as directed by the City Engineer and post surety to guaranty the work. Grading/Drainage Plan: Provide a grading and drainage plan for review by the City Engineer. Encroachment Permit: Obtain an encroachment permit and pay fees and deposit for all work in the public right-of-way. Final Map: Process and file a final subdivision map. Private Street Name: Applicant shall submit required application for private street name designation if Dot Avenue addresses are not used. Park Dedication: Applicant to pay a fee in lieu of dedicating park land which will be assessed at the time of final map approval. The proposed map allows the creation of four new lots.
