PC Res 2954RESOLUTION NO. 2954 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL REVOKING A PREVIOUSLY-APPROVED CONDITIONAL USE PERMIT, WHICH ALLOWED THE EXPANSION OF AN AUTOMOBILE SHOWROOM (NOSTALGIA MOTORS) LOCATED AT 126 HARRISON AVENUE IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT, DUE TO A LACK OF COMPLIANCE WITH THE CONDITIONS OF APPROVAL. CITY- INITIATED APPLICATION. FILE NO. UP 94-06. After notification and Public Hearing as specified by law on the City-initiated application to revoke a Conditional Use Permit which allowed the expansion of an automobile showroom located at 126 Harrison Avenue, and after presentation by the Planning Director, proponents and opponents, the hearing was dosed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 94-06: The applicant has not complied with the Conditions of Approval placed on the project by the Planning Commission on September 13, 1994. The applicant was provided with a Notice of Non-Compliance pursuant to Section 21.72.110 of the Zoning Ordinance and given an additional 30 days to comply with the Conditions of Approval. Therefore, the Planning Commission, hereby, also finds in conclusion that: The establishment, maintenance, or operation of the use applied for will is detrimental to the health, safety, peace, morals, comfort or general Welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. 2. The proposed use is not compatible with the uses in the area. o The proposed project is not in conformance with the policies contained in the North of Campbell Avenue Special Project Area, the City of Campbell Zoning Ordinance, and the City of Campbell General Plan.
