PC Res 2956RESOLUTION NO. 2956 BEING A RESOLUTION OF THE PLANNING COMMISSION FOR THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A FREEWAY-ORIENTED SIGN ALLOWING THE IDENTIFICATION OF BREUNERS LOCATED AT 525 E. HAMILTON AVENUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. FILE NO. SA 95-06 After notification and Public Hearing, as specified by law, on the sign application to recommend approve of a freeway-oriented sign allowing the identification of Breuners on property located at 525 E. Hamilton Avenue, and after presentation by the Community Development Director, proponents and opponents, the hearing was dosed. After consideration of all evidence presented, the Planning Commission did find as follows with regard to file SA 95-06: The sign height, and reduced sign area recommended by staff is the minimum size necessary to provide identification of the use from the freeway, and for traffic to safely exit the southbound Hamilton Avenue exit. 2. The site currently maintains a 624 square foot roof mounted freeway sign. ge Breuners is a regional use that depends upon freeway signage to provide identification of the store location, and has historically been located on sites near freeways or expressways to facilitate identification and access. The building occupied by Breuners is adjacent to the freeway, and is not highly visible from Highway 17 due to dense row of trees, and a 16 foot soundwall along the eastern property line. The sign has no flashing, moving or roving parts or lights, and is located 215 feet from the northern property line to avoid impacting the adjacent residential uses to the north. o There is no evidence presented by the applicant that a hardship would be created for Sportmart and Office Depot if these uses are not identified on the freeway oriented sign. The applicant has not demonstrated that Sportmart or Office Depot are dependent upon freeway identification. ge Office Depot and Sportmart will be identified on the freestanding sign that will be located on the frontage of the parcel. Hamilton Avenue -- Breuners Site Adopted on March 14, 1995 Page 2 The freestanding sign is highly visible from the Hamilton Avenue frontage. 10. Five of the six locations for Office Depot and Sportmart within Santa Clara County indicated do not rely on or have freestanding freeway oriented signs. The remaining location is within a large scale shopping center. 12. The uses are located in proximity to other large volume retailers. The traffic report prepared for S 94-09 indicates that Office Depot and Sportmart will receive spill over traffic in addition to normal traffic generation which indicates that the uses are not dependent upon freeway identification. Based upon the foregoing findings of fact, the Planning Commission concludes that: The use is of such size and is so located in reference to the surrounding uses and the traffic circulation system that additional signage is appropriate. The sign would not be detrimental to the public welfare or persons in the neighborhood or the City as a whole. 3. The proposed freeway sign is limited to identification of the existing business on the site. The business operation is dependent on freeway identification, and denial of the identification would create an undue hardship for Breuners. o The proposed businesses (Sportmart and Office Depot) are not dependent upon freeway identification, and denial of the identification would not create an undue hardship for these uses. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinance of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: Planning Commission Resolution No. 2956 SA 95-06 -- 525 E. Project Approval: Approval for this project is granted to construct a freeway oriented sign located adjacent to the soundwall along the eastern property line approximately 215 from the northern property line (per site plan) and shall conform to the following: 2. Sign Height: Sign height shall not exceed 38 feet as indicated on the plans. o Reduced Letter/Sign Size: Applicant to submit revised plans reducing the size of the letters and the sign to a size that is visible for a maximum of 1000 feet from the southbound Highway 17. Letter and sign size shall be subject to review and approval by the Community Development Director. o Sign Content: Sign display area shall identify Breuners only. Revised plans must be submitted indicating the removal of Sportmart and Office Depot from the freeway oriented sign. The word "Center" or similar wording may be incorporated into the sign. Sign Orientation/Illumination: The sign face shall be oriented toward the freeway and away from the residential area to the north to avoid impacting the residential area. Approval is granted to illuminate the sign letters only. The background shall not be illuminated. The intensity of illumination shall meet the specifications on the plans stamped and dated March 8, 1995. The sign letters shall be illuminated only during regular business hours. o Permits: Applicant shall obtain all necessary permits from the Building Division prior to installation. Roof Mounted Sign: The existing roof mounted freeway oriented sign shall be removed prior to the issuance of building permits for the new freestanding freeway oriented sign and shall not be erected at any time after this approval. o Landscape Plan: The applicant shall submit a landscape plan indicating screening of pole support within a planter area to make the support less visible from the rear parking lot area.
