BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL APPROVING A SITE AND
ARCHITECTURAL APPLICATION TO ALLOW THE
CONSTRUCTION OF 36 SINGLE-FAMILY RESIDENCES LOCATED
ON PROPERTY AT 1510 W. -HAGIENDA[ AVENUE IN AN R-l-9
(SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT.
APPLICATION OF NEW CITIES DEVELOPMENT. FILE NO. S 95-
03.
After notification and Public Hearing as specified by law on the above-
referenced application as per the application filed in the Planning Department
on March 2, 1995, and, after presentation by the Community Development
Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. S 95-03:
The proposed building design incorporates representative architectural
features of homes in the San Tomas Area.
Exterior elevations are significantly varied throughout the project as
required by the San Tomas Area Neighborhood Plan.

The proposed landscaping exceeds the requirements of the San Tomas
Area Neighborhood Plan.
Based upon the foregoing findings of fact, the Planning Commission
concludes that:
The proposed project is consistent with the policies of the General Plan,
Zoning and the San Tomas Area Neighborhood Plan.

The proposed project will aid in the harmonious development of the
immediate area.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed, subject to the following Conditions of
Approval:

1. Approved Pro!ect
Approval is granted for a Site and Architectural Review Permit to allow
the construction of 36 single-family homes. Development shall be
substantially as shown on the project materials listed below, except as may
be modified by the conditions contained herein:

12 sheets dated received March 28, 1995 on file in the Community
Development Department.

Materials board consisting of four sheets. Sheets one and two dated
March 11, 1995 and sheets three and four dated March 27, 1995.
2. Revised Elevations
The applicant shall submit revised elevations, for review and approval by
the Community Development Department prior to the issuance of
building permits, addressing the continuation of the wainscoting from the
front facade to the side elevations.
3. Landscape Plan

Applicant shall submit a final landscape plan to the Community
Development Department for approval prior to the issuance of
building permits.

Irrigation from lot 1 shall be provided to landscape improvements
along Pollard Road and the soundwall. The property owner of lot 1
shall be responsible for watering landscaping the parkway, the
landscaping adjacent to the soundwall on the Pollard Road side of
the fence and other public places abutting lot 1.
4. Color and Materials Palette

Any changes to the approved color and materials palette shall be
submitted and approved by the Community Development
Department prior to the issuance of building permits.
b. Roof materials shall consist of .textured composition shingles.

5. Exterior Design Variation
Unit types shall be located as shown on the approved site plan, sheet 12.
Modifications to the unit type shown on the site plan (i.e. the use of the
standard or alternative front elevation) shall be approved by the
Community Development Department if said modifications comply with
the San Tomas Neighborhood Area Plan regarding Exterior Design
Variation. Any modifications shall be approved prior to the issuance of
building permits.
6. Building Permits
Obtain all necessary building permits. Building permits shall not be issued
prior to recordation of the final map.
7. Fencing Plan
The applicant shall submit a final fencing plan for fencing along the
eastern boundary of the Santa Clara Valley Water District. The fencing
shall allow SCVWD vehicular access to the easement. The plan shall also
provide access to the easement for each property owner with land
containing the easement. Applicant shall provide verification from
SCVWD approving the plan. The final fencing plan shall be approved by
the Community Development Department.
8. Final Map
Site and Architectural approval is contingent upon approval by the
City Council of the final subdivision map as substantially shown on
the site plan on sheet 12 of the approved plans. In the event the
approved final subdivision map differs from the site plan on sheet
12, the applicant shall modify the plans as necessary to comply with
setbacks and other requirements contained in the San Tomas Area
Neighborhood Plan and Campbell Municipal Code.

Minor modifications may be approved by the Community
Development Director. Should the Community Development
Director determine that the modifications substantially alter the
character of the approved plans, revisions shall be referred to the
Planning Commission for approval.

9. Architectural Projections
Bay windows extending in the required yard areas are subject to approval
by the City Council of Text Amendment 95-01. Should the Text
Amendment be denied or modified by the City Council, the applicant shall
modify the plans as necessary.
10. Construction Mitigation Measures
Hours of construction shall be limited to 8 a.m. To 5 p.m. Monday through
Friday and 9 a.m. To 4 p.m. On Saturdays. No construction activities shall
take place on Sundays or holidays.
11. Garbage Collection
Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, and rubbish
produced within the limits of the City of Campbell shall be made with
Green Valley Disposal Company.
12. Property Maintenance:
The applicant is hereby notified that the property is to maintained free of
any combustible trash, debris, and weeds until the time that actual
construction commences, All existing structures shall be secured by
having windows boarded up and doors sealed shut, or be demolished or
removed from the property. Section 11.201 & 11.414, 1985 Ed. Uniform
Fire Code.
13. Roadways and Hydrants
a. Roadways and hydrants to be in place prior to start of framing.
Fire hydrants and appurtenances shall be provided and installed at
the locations specified by the Fire Marshall of the Central Fire
District.

14. Dust Control:
The measures below shall be followed to control of dust and wind erosion.
Said mitigation measures shall be depicted on the construction plans.
All exposed or disturbed soil surfaces shall be water as necessary to
control dust, but not less than twice daily, including weekends. A
dust suppressant shall be added to the water prior to application.

Areas of digging and grading operations shall consistently watered
to control dust.
Ce
Grading or other dust-producing activities shall be suspended
during periods of high wind when dust is readily visible in the air.

Stockpiles of soil, debris, sand, or other dust-producing materials
shall be watered or covered.
The speed of all vehicles on-site shall be limited to 15 miles per
hour.

The construction area and the surrounding streets shall be swept as
necessary, but not less than once daily.
15. Lot 1 Noise Mitigation

A seven-foot high wall shall be constructed along the southern
property line of the site of Lot 1. A six-foot high sound wall shall be
constructed along the western property line of Lot 1. The design
and materials of the sound wall shall be submitted to the
Community Development Department for review and approval
prior to installation. The sound wall shall be construction prior to
occupancy the home on Lot 1.

Glass on building elevations facing Pollard Road shall meet a
Sound Transmission Class rating of 27. This applies to glass areas
that are not shielded by the sound wall.
c. The home on Lot 1 shall contain a mechanical ventilation system.

Exterior doors shall be one and three-quarter inch solid core doors
with perimeter seals.

An acoustical engineer shall review the future building plans for
Lots 1. The engineer shall certify that the building plans will
comply with HUD noise criteria and shall specify additional
measures necessary to comply with the criteria. Said certification
shall be provided prior to issuance of building permits for the
home.
