BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A
ZONE CHANGE (PLN2010-161) FROM P-O (PROFESSIONAL
OFFICE) TO P-D (PLANNED DEVELOPMENT) ON PROPERTY
LOCATED AT 700 GALE DRIVE.
After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application PLN2010-161:
Environmental Finding
1. A Mitigated Negative Declaration has been prepared for this project concluding that
there are no significant unmitigated impacts associated with this project, pursuant to
the California Environmental Quality Act (CEQA).
Evidentiary Findings
2. The proposed P-D zoning designation would be allowed with the proposed Low-
Medium Density Residential (6-13 units per gross acre) General Plan land use
designation for the property with the approval of both a General Plan Amendment
and a Zone Change.
3. The proposed density of 11.1 units per gross acre is below the maximum allowed
density range of 13 units per gross acre permitted in the Low-Medium Residential
General Plan land use designation.
4. The proposed development will not result in allowing more residential units than
would be allowed by other residential zoning districts which are consistent with the
recommended General Plan land use designation of the property.
5. The zoning designation change from P-O to P-D allows for desirable development of
an under utilized property consistent with surrounding residential neighborhood and
is consistent with the density range found in the area.
6. The zoning designation change from P-O to P-D allows for the development of
residential units under separate ownership as opposed to the development of a
multi-family dwelling on a single lot (i.e. apartment complex) that is normally found
associated with the proposed Low-Medium Density Residential General Plan land
use designation, which creates a more desirable project that is consistent with the
current development pattern of the neighborhood.
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:

1. The proposed amendment is consistent with the goals, policies, and actions of the
General Plan.
2. The proposed amendment would not be detrimental to the public interest, health,
safety, convenience, or general welfare of the City.
3. The parcel is physically suitable (including absence of physical constraints, access,
compatibility with adjoining land uses, and provision of utilities) for the requested
zoning designation and anticipated land uses/project.
4. The development and uses will be compatible with the General Plan of the City and
will aid in the harmonious development of the immediate area.
5. No substantial evidence has been presented from which a reasonable argument
could be made that shows that the project, as currently presented and subject to the
required conditions of approval, will have a significant adverse impact on the
environment.
THEREFORE, BE IT RESOLVED that the Planning Commission recommends approval
of a Zone Change (PLN2010-161) from P-O (Professional Office) to P-D (Planned
Development) on property located at 700 Gale Drive.
