PC Res 2967RESOLUTION NO. 2967 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO ALLOW AN ANIMAL HOSPITAL ON PROPERTY LOCATED AT 1800-1820 W. CAMPBELL AVENUE IN A C-1-S (NEIGHBORHOOD COMMERCIAL) ZONING DISTRICT. APPLICATION OF KIRKWOOD ANIMAL HOSPITAL. FILE NO. UP 95-03B. After notification and Public Hearing as specified by law on the application of Kirkwood Animal Hospital to approve a Conditional Use Permit allowing day care facility on property located at 1800-1820 W. Campbell Avenue, and after presentation by the Planning Director, proponents and opponents, the hearing was dosed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 95-03B: The location of the animal hospital and the on-site improvements shall provide reasonable vehicular and pedestrian circulation. o A total of 12 parking spaces and shared parking facilities will be provided which has been determined by the Community Development Department to adequately serve the proposed use. ge The Conditions of Approval generated for the proposed project will ensure that impacts due to noise will be minimized so as not to unreasonably interfere with adjoining properties or uses. o No substantial evidence has been presented which shows that the project, as currently presented, and subject to the required conditions, would have a significant adverse impact on the environment. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Campbell Avenue - Kirkwood~Animal Hospital Adopted on April 11, 1995 Page 2 The proposed site is adequate in size and shape to accommodate the walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. ge The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate; 4. The proposed use is compatible with the uses in the area. Further, the applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Approved Project This approval is for a use permit to allow the establishment of approximately 2,500 square foot animal hospital at a proposed building located at 1800-1820 W. Campbell Avenue in a C-1-S (Neighborhood Commercial) Zoning District. Development shall be substantially as shown on the materials listed below, except as may be modified by conditions contained herein. Site plan submitted for 1800-1820 W. Campbell Avenue, dated March 14, 1995, as modified be the Community Development Department staff. If at any time the use is not in compliance with conditions herein, or State, County, or local requirements, the use permit may be revoked pursuant to Section 21.72. 110 of the Campbell Municipal Code. e Hours of Operation Hours of operation shall be limited from 6 a.m. to 9 p.m. daily. Campbell Avenue - Kirkwood Animal Hospital Adopted on April 11, 1995 Page 3 o o Parking Prior to the issuance of any occupancy permits, a minimum of 12 parking spaces within the common parking facilities shall be provided and maintained on site for the proposed use. Fire Codes The facility must comply with all applicable regulations adopted by the State, and the Central Fire District. Other Permits The applicant must obtain all necessary permits from the County of Santa Clara and the State of California. Approved Use: The use shall be limited to small animal care such as dogs, cats, birds and the like. Noise Level: The entire clinic, including treatment rooms, cages or pens shall be maintained with a completely enclosed sound proof building constructed of materials which will ensure that no sound exceeding 65 decibels shall be audible on the exterior of the building. The clinic shall also be provided with an air conditioning which is adequate to prevent the necessity of opening doors and windows for ventilation, or the applicant may supply information that adequate ventilation exists in the building without opening doors or windows. (Planning) Boarding: Animals shall be treated on an out-patient basis and no overnight boarding shall be permitted, except that animals may be kept overnight on the premises for treatment purposes only. (Planning) Odors: The clinic shall be designed and operated in such a manner as to guarantee that no objectionable odors or noises shall be produced outside its walls and provisions for off-site disposal of all dead animals and of all waste materials shall be made in compliance with County Health Standards. The removal of such waste materials and dead animals shall be done so as to guarantee that no obnoxious odor is produced. There shall be no burning or other disposal of dead animals on the premises. Hazardous Materials: Prior to moving any hazardous material/gases on-site, an approved Hazardous Materials Management Plan (HMMP) must be on file. (Note: If amount of gas/chemicals are above reportable limits, full CEQA may be required.) (Fire) 11. Waste Disposal: Comply with Fire Department waste disposal requirements. (Public Works) PROPERTY MAINTENANCE 12. Trash Enclosure: Provide concrete trash receptacle area with proper screening. ZONING COMPLIANCE 13. Conditional Use Permit: Conditional Use Permit is not valid until City Council approval of the General Plan Amendment (GP 95-03) and Zone Change (ZC 95-03) for this portion of the site.
