BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL TO ALLOW A NEW SINGLE FAMILY
RESIDENTIAL DWELLING AND DETACHED GARAGE ON
PROPERTY LOCATED AT 1600 VAN DUSEN LANE IN AN R-l-9
(SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT.
APPLICATION OF MR. BRUCE JOHNSON, ON BEHALF OF
SWART DEVELOPMENT. FILE NO. S 95-09.
After notification and Public Hearing as specified by law on the above-
referenced application as per the application filed in the Planning Department
and, after presentation by the Community Development Director, proponents
and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. S 95-09:
The proposed dwelling is well designed and is architecturally compatible
with the surrounding area with the architectural enhancements such as
a new porch element and mullioned windows.

The proposed project meets the development standards of the R-l-9
Zoning District and the San Tomas Area Neighborhood Plan.

The development of the property will result in a density of 3.1 units per
gross acre which is consistent with the General Plan density of less than
4.5 units per gross acre shown for this area.
The proposed landscaping of the site will greatly contribute to the quality
of the development and enhance the neighborhood.
The reduced fence height along the Van Dusen Lane elevation is in
keeping with the area and the San Tomas Area Neighborhood Plan.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The proposed project is consistent with the General Plan and zoning,
and

The proposed project will aid in the harmonious development of the
immediate area.

Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed, subject to the following Conditions of
Approval:
Approved Project: Approval is granted for a Site and Architectural
Review Permit allowing a new single family residence and three (3) car
detached garage on property located at 1600 Van Dusen Lane. Project
approval shall substantially comply with project plans prepared by Bruce
Johnson dated June 12, 1994, except as modified by the Conditions of
Approval herein.
Fences: Submit a revised fencing plan indicating location and details of
fencing including reduction of the fence height for all fencing except for
the enclosure of the private yard area as indicated on the site plan for
approval by the Community Development Director, prior to issuance of
building permits.

Landscaping: Submit four (4) copies of a landscaping plan indicating type
and size of plant material, planting details and irrigation system for the
front yard to be submitted to the Community Development Department
prior to issuance of building permits. (Planning)
Performance Bond: Applicant to either: 1) post a faithful performance
bond in the amount of $5,000 for the subject property to ensure
landscaping, and fencing within three months of completing construction
and prior to final occupancy; or 2) file a written agreement to complete
landscaping, fencing and driveway areas prior to final occupancy.
Park Impact Fee: Per City Council Resolution 8812, the applicant shall pay
a park impact fee of $5,495 (50% of $10,990) for the new single family
residence prior to certificate of building occupancy. (Public Works)
Driveway Improvements: Install driveway on Van Dusen Lane as
necessary, including removal and replacement of curb and gutter and
sidewalk.
7. Landscape Improvements: Provide trees, irrigation and related
improvements in the public right-of-way.

Grading and Drainage Plans: Provide conceptual grading and drainage
plans for review by the City Engineer with sufficient information to
demonstrate the proposed grading and drainage concept and compliance
with Chapter 70 of the UBC.
9. Standard Specifications & Details: Comply with the current City of
Campbell Standard Specifications and Details for Public Works
Construction.
10. Streets and Sidewalks: Comply with Title 11 of the Campbell Municipal
Code concerning Streets and Sidewalks.
Il. Americans With Disabilities Act and California Disability Access
Regulations: Comply with the Americans With Disabilities Act and the
California Disability Access Regulations, whichever applies.
12. Underground Utilities: Cause all electrical, telephone and cable television
fadlities to be installed underground in accordance with the provisions of
Chapter 20.36.150 of the Municipal Code and as required by the City
Engineer, prior to occupancy.
13. Sanitary Sewer Service: Install a sanitary sewerage system in
conformance with the requirements of the West Valley Sanitation District.
14. Water Service: Install a water distribution system in conformance with
the requirements of the San Jose Water Company.
15. Storm Drain Area Fee: Pay the then current storm drainage area fee.
Amount is $2,000 per acre effective July 1, 1995.
16. Security: Provide guarantees to design and construct all public
improvements by cash, bonds, letters of credit or other legal instruments
acceptable to the City Attorney.
17. Encroachment Permit: Obtain permits and approvals for work on State of
California property (street right-of-way). Permits and approvals must also
be coordinated with the City of Campbell.
18. Completion Prior to Occupancy: Complete construction of all required
off-site and on-site improvements prior to occupancy of any structure.

19. Utility Construction Coordination in Public Right-Of-Way: Submit a
Utility Coordination Plan and Schedule for approval by the City Engineer
for installation of electrical, telephone, cable television, sewer, water and
storm drain improvements to minimize damage to City streets, sidewalks
and related facilities.
20. Parking and Driveways: All parking and driveway areas shall be
developed in compliance with the standards in Chapter 21.50 of the
Campbell Municipal Code. (Planning)
21. Development Approval Expiration: The Site and Architectural approval
for this project is valid for a period of one year from the Planning
Commission approval. (Planning)
