A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE CITY ENGINEER TO EXECUTE AN AGREEMENT WITH THE
CITY OF SAN JOSE FOR THE LEIGH AVENUE/DRY CREEK ROAD INTERSECTION
IMPROVEMENT PROJECT AND APPROVING A BUDGET ADJUSTMENT; AND
SUPPORTING PURSUIT OF A SAFE ROUTES TO SCHOOL GRANT FOR THE
LEIGH AVENUE SIDEWALK INFILL PROJECT
WHEREAS, the City Council adopted Resolution No. 11237 authorizing Public Works
staff to approach Caltrans with a request to reassign federal Highway Safety
Improvement Program (HSIP) grant funds from the Campbell Avenue/Leigh Avenue
Signalization Project 10-DD to the Leigh Avenue/Dry Creek Road Intersection
Improvement Project; and
WHEREAS, the Leigh Avenue/Dry Creek Road Intersection Improvement Project would
address pedestrian access needs of Campbell students who walk to Bagby Elementary
School in San Jose via the Leigh Avenue/Dry Creek intersection; and
WHEREAS, the northwest quadrant is located in Campbell; and
WHEREAS, the City of San Jose was awarded approximately $280,000 in federal
Vehicle Emissions Reductions Based at Schools (VERBS) grant funds for the Leigh
Avenue/Dry Creek Intersection Improvement Project; and
WHEREAS, the estimated cost for the Leigh Avenue/Dry Creek Intersection
Improvement Project is $340,000; and
WHEREAS, a Campbell contribution of $50,000 would reduce the funding shortfall for
the Leigh Avenue/Dry Creek Intersection Improvement Project; and
WHEREAS, the Campbell contribution of $50,000 could be funded with Construction
Tax funds; and
WHEREAS, the Campbell Construction Tax Reserve will be replenished with
approximately $26,000 to $36,000 in Construction Tax local matching funds released
from the Campbell Avenue/Leigh Avenue Signalization Project 10-DD after that project
is closed out; and
WHEREAS, the City of Campbell has sent Caltrans a letter expressing the City's intent
to drop the Campbell Avenue/Leigh Avenue Signalization Project; and
WHEREAS, Caltrans and the Federal Highway Administration (FHWA) have yet to
decide on whether to allow Campbell to keep approximately $10,000 in reimbursed
HSIP funds; and

WHEREAS, the City of San Jose has requested confirmation of a $50,000 Campbell
contribution to the Leigh Avenue/Dry Creek Road Project by August, 2011; and
WHEREAS, Campbell will execute acost-sharing agreement with the City of San Jose
to facilitate the Campbell contribution and allow San Jose Department of Transportation
staff to proceed with the design and construction of the Leigh Avenue/Dry Creek Road
Project; and
WHEREAS, the Safe Routes to Schools (SRTS) grant program is afederally-funded
program administered by Caltrans to encourage construction of pedestrian safety
projects; and
WHEREAS, asix-inch asphalt concrete (AC) dike separates pedestrians from high-
speed traffic on southbound Leigh Avenue between Dry Creek Road and Bent Drive;
and
WHEREAS, the Leigh Avenue Sidewalk Infill Project includes the design and
construction of new sidewalk, curb, gutter, and curb ramp on the west side of Leigh
Avenue between Dry Creek Road and Bent Drive; and
WHEREAS, this work is not included in the project scope of San Jose's Leigh
Avenue/Dry Creek Intersection Improvement Project; and
WHEREAS, the Leigh Avenue Sidewalk Infill Project is estimated to cost $60,000 to
design and construct; and
WHEREAS, the Leigh Avenue Sidewalk Infill Project would encourage walking and is
therefore eligible for SRTS funding; and
WHEREAS, the ability to obtain SRTS funding approval is enhanced by endorsement of
the project by elected officials, school officials, and police departments; and
WHEREAS, the SRTS grant program requires no local match for the City of Campbell.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Campbell
that the City Engineer is hereby authorized to execute acost-sharing agreement
between the City of Campbell and the City of San Jose for the Leigh Avenue/Dry Creek
Road Intersection Improvement Project in an amount not to exceed $50,000.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
approves the budget adjustment to reallocate $50,000 in Construction Tax Reserves
funds to the Leigh Avenue/Dry Creek Road Intersection Improvement Project and
related transfers.

BE IT FURTHER RESOLVED by the City Council of the City of Campbell that the City
Engineer is hereby authorized to execute, file and pursue Safe Routes to Schools Grant
Funds in the amount of $60,000 for the Leigh Avenue Sidewalk Infill Project.
