BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL APPROVING A MODIFICATION TO
ALLOW A SECOND STORY ADDITION WITH A FIVE FOOT
SIDE YARD SETBACK FOR A RESIDENCE LOCATED AT 620
MAPLE AVENUE IN AN R-l-9 (SINGLE FAMILY
RESIDENTIAL) ZONING DISTRICT. FILE NO. M 95-03.
After notification and hearing on the application of Ms. Janet Adams, on behalf of
Mr. and Mrs. Ken Lehman, as per the application filed in the Planning
Department; and, after presentation by City Staff, proponents and opponents, the
hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows with respect to File No. M 95-03:
The placement of second story windows on the side elevations of the
dwelling addresses issues of privacy relating to the adjoining neighbors.
The proposed design and expansion of the existing dwelling is compatible
with the existing dwelling and homes in the neighborhood.
The proposed sideyard setback modification is supported by the Site and
Architectural Review Committee subject to the enhancement of the porch
element and the continuation of the existing building materials.

The proposal meets the intent and purposes of the zoning ordinance
allowing a reduction in the required setback because the proposed setback
will not adversely affect the adjoining property owners or the neighborhood.

The proposed reduced side yard setback will not unreasonably interfere with
the ability of the adjacent property owners to enjoy access to sunlight, air,
privacy or quiet enjoyment of said owner's property.
Based upon the foregoing findings of fact, the Planning Commission concludes
that:
Said side yard will not be detrimental to the health, safety, peace, comfort or
general welfare of persons in the neighborhood or the City as a whole; and
o
That the side yard will not unreasonably interfere with the ability of adjoining
property owners to enjoy access to sunlight, air, privacy or quiet enjoyment of
such owner's property, subject to the conditions of approval for this project.

The development and uses will be compatible with the General Plan of the
City and will aid in the harmonious development of the immediate area.
Further, the applicant is notified as part of this application that he is required to
comply with all applicable Codes and Ordinances of the City of Campbell and the
State of California that pertain to this development and are not herein specified.
Approved Project: This approval is for a modification to the sideyard setback
requirement of the R-1 (Single Family Residential) zoning district to allow a
five foot side yard setback along the eastern property line for a new second
story addition on an existing single family dwelling located at 620 Maple
Avenue Drive.
A. Project Plans: Project shall substantially adhere to revised project plans
prepared by Janet Adams, dated July 27, 1995.
Details: Applicant shall submit details concerning the porch treatment
and support posts subject to review and approval by the Community
Development Director prior to issuance of the building permits

Horizontal Siding: The horizontal siding shall be consistent with the
siding on the existing first floor elevations and shall be specified in the
building plans.

Second Story Addition Design: The second floor addition is to be designed by
a licensed architect or engineer with plans stamped and signed by same.

Construction
Construction and Equipment: Applicant shall utilize construction
equipment which adequately levels the noise in accordance with Section
18.02.030 of the City of Campbell Municipal Code. Construction activity
and construction equipment shall comply with all air quality emission
policies as determined by the Bay Area Air Quality Management District
and the Building Official for the City of Campbell.

Construction Hours: Hours of construction shall be limited to 8 a.m. To 5
p.m., Monday through Friday, and 9 a.m. To 4 p.m. Saturdays. No
construction is permitted on Sundays or Holidays.

Construction Site:
1. The construction site shall be sprinklered with water, as necessary,
to control dust.
2. Haul trucks and material stockpiles shall be covered with tarpaulins
or other material acceptable to the City.
3. The construction area and surrounding areas shall be swept as
necessary, but not less than once daily. All areas shall be adequately
fenced or appropriately secured for safety per the Building Official
during construction and demolition.

Demolition Permit: Applicant is required to obtain a demolition permit,
subject to review and approval by the Building Official, prior to demolition of
any structure on the site.

Underground Utilities: Install, electrical, telephone, and cable television
facilities in accordance with Chapter 20.36.150 of the Campbell Municipal
Code and as required by the City Engineer, prior to occupancy.

Parking and Driveways: All parking and driveway areas shall be developed
in compliance with the standards in Chapter 21.50 of the Campbell Municipal
Code.

Storm Drain Area Fee: pay the then current storm area fee prior to issuance of
a building permit. Current amount is $2,000.00 per acre.
